Refund on credit card

Hi, i'm hoping someone can help me.
On 1st May 2008 i bought 5 tickets for a concert totalling £256 on my HSBC credit card. I bought the tickets from the Hall for Cornwall, who were selling the tickets on behalf of Camellia MC Productions. The concert was due to take place on 4th September 2008, but was cancelled at the end of August due to poor ticket sales. I immediately contacted the Hall for Cornwall to request a refund and was told that all moneys had been passed on to Camellia and that the company was most likely going to be placed into liquidation. I then contacted my card company and was told that until i had written proof that i would not be getting my money back, they would not do anything. As soon as the liquidator was announced i wrote to them and recieved a letter dated 20th November informing me that i had been added to the list of creditors but i was unlikely to get any money back as the company had very little in the way of assets. I received another letter dated 29th December, stating that i would not be getting a refund so i immediately contacted my card company, sending them copies of all letters that i had received. I received 2 letters from HSBC, dated the 7th and the 19th January 2009 asking for the date of the concert which i sent to them immediately each time. I then received a letter dated 2nd February 2009 from HSBC stating that my credit card account had been credited with £256.
Of course i was delighted... until yesterday!!
I received a phone call yesterday from HSBC stating that they had tried to get the money back from the Hall for Cornwall but because the tickets had been bought more than 180 days ago the Hall for Cornwall will not refund the card company. HSBC have now told me that they are going to charge the £256 back onto my credit card.
Can they do this? Help please!!

    im sure thats wrong i understand you have 6 years to make a claim under section 75
  • I'm not sure that section 75 applies here though as the tickets were purchased through a third party and not direct from the company providing the service.

    As above:

    Hall of Cornwall were effectively acting as an agency therefore they were contracted to provide a ticket rather than the concert.

    secondly, 5 items worth £51.20 were effectively purchased rather than item over £100 so Section 75 would not apply.

    So where do i stand then? Is there any chance of me keeping the refund they issued in February?

    Yes why would they claim it back?

    I would suggest you contact the Financial Ombudsman, details should be on your cc statement/t&c's.
