Hi peeps
Need some help, having a bad time atm so any advice welcome just a few questions about DRO and joint debt with the ex
1, My name is currently on my old property, which i no longer live in my ex has said she is trying to get my name taken off but will it stop me getting a DRO even though im no longer living there or paying money onto it?
2, Joint debt? can i include this into a DRO? ie we have a joint bank account with £5000 overdraft on it can i include say £2500 paying off half of what i owe ? i also have a joint loan can this be done the same?

As far as I am aware yes it will be counted as an assett as you still have an interest in it even if you do not live there.

All joint debts have to go down in FULL. You are both jointly and severally
responsible for the debt. So a DRO or BR will wipe the whole amount for you but your Ex will still be responsible for the full amount when you petition.

How is your name on the property? Tenancy Agreement? Electoral Roll? either way if you dont live there then there is no problem UNLESS!!! you mean that you had a joint mortgage on this house and your name is still on the mortgage? if so then you wouldnt qualify for a dro as you would have assets of more than £300.

If you owe £5000 as a joint debt then you get joint and severable liability, so therefore you put down the WHOLE £5000 and that is included in the dro, no collection attempts can be made by ANYONE towards you for that debt and the ENTIRE amount then becomes payable by your ex and your ex only, the debt collectors will focus ALL of their energy on getting it from him.
