Halifax - Can I claim again for further charges if I have claimed before and....

....signed a small slip?

Claimed early 2007 and received a payout but was asked to sign a very small slip to say I wouldn't claim again.

My question is (as I don't have that slip) is it legally binding and can I claim again for charges since the last claim?

I would be claiming under the hardship rule if that make any difference?

    Up to 2007 it is legally binding cos you signed it. However since the date of the refund then you have a case for the charges.

    Ahhh so if I find the exact date I was refunded I could claim from that date?

    Its basically from the last charge refunded because most forms stated that it was in full and final settlement of your claim for bank charges. You couldn't sign away your current rights.
    Moving onto financial hardship element, do you have priority debt arrears(mortgage/rent, council tax, utilities)?

    I thought as much - aren't you good :)

    Mortgage down to interest only but have drastic gas & electricity arrears (Direct Debit amounts not covering what was used - not lack of paying) which have pushed payments up starting from next month to scarily high figures!

    I was think, sending a copy of these bills along with statement of affairs?
  • Sounds like a plan to me, have you had those debt arrears payments bounced? SO have the bank bounced the gas and electricity payments?

    Joint account frozen (after a mountain of charges in one go last month) so allows no direct debits to come out but also the DD that were set up by the utilities company weren't covering usage...so it's not down to the bank really...the onus is on myself and the utilities company. Perhaps that will affect things when claiming?

    the bank charges haven't contributed to the financial hardship unfortunately so I can see their response being a no.
    However if they have made huge charges then nothing stops you from asking the question and if you get a yes then it is a bonus.

    Going back over the years it has - but I see the point you're making.

    All I can do is send off the list of charges from the refund date in 2007 and go from there.

    If the hardship case is a no, I suppose I just join the hold queue like everyone else.

    Yes from 2007 and no problems.....I would love to be wrong(so if I am then politely gloat ;) )
