    No it isn't.
    From the Postal Services Act 2000

    84 (3)
    A person commits an offence if, intending to act to a person’s detriment and without reasonable excuse, he opens a postal packet which he knows or reasonably suspects has been incorrectly delivered to him.

    There is a reasonable excuse in this case and no intention to act to anyones detriment.

    I used to send them back but tbh it has happened so many times not just with this company but with lots of payday loan companies that I just started opening them to see what was going on. Seemed a bit strange to keep getting letter after letter, they are all new loans too not even letters chasing up repayments from old loans.
    I'll just keep checking my credit reports and hopefully this is the last i'll hear from them.

    I wouldn't bother. If you're not associated with anyone you don't need to disassociate. The old saw about credit ratings affecting an address and everyone who lives there isn't valid now (if indeed it ever was)

    It is not illegal to open another persons mail unless you intend to commit fraud - this is frequently incorrectly posted:)
    I live in my head - I find it's safer there:p

    it is not - that is an urban myth.

    It is a criminal offence to open mail with the intention of committing another offence (eg fraud).

    Do check whether they are still on the electoral roll? That would make it easier for them to get credit at your address.

    And if you think that someone is using your address to commit fraud, you'd be nuts to simply return the mail.
