You need to decide what you really want.
You could try an item significantly not as described, but if the description doesn't say what condition it is and the photograph is of the item as received (even if its a poor photo) you may lose the claim as it says it is used.
Even if you win a claim, you'll be expected to return the item in the condition it was received so don't clean it up until you are certain you want to keep it.
If you want to keep the item, you could ask for a partial refund but the seller is under no obligation to provide one.
Start by deciding what you really want and then, if appropriate, contact the seller and explain how disappointed you were with the item and perhaps suggest some resolutions you would accept (but the only one the seller may accept, if any, is to return at your expense for a full refund)."Now to trolling as a concept. .... Personally, I've always found it a little sad that people choose to spend such a large proportion of their lives in this way but they do, and we have to deal with it." - MSE Forum Manager 6th July 20100 -
Well, it's up to yourself really. Would you be happy to keep it if you cleaned it up? If the answer is no, I'd get in touch with your seller and see what they say.0

thanks for the reply guys
id keep it if he issued a partial refund as its damaged from underneath which wasnt mentioned (colors stripped off)
and totally dirty
if not i dont want to keep it at full price.
the picture in the discription is a good picture and i think the picture shows a new version of it not the used dirty moth/flees infested of it.
should i contact him and state this ?0
