Can I reclaim bank and credit card charges?

Hi, this is the first time I've posted a question on here so please be gentle with me!

On the 9th Feb this year I was made bankrupt (owing to an ex-wife and divorce) and now feel free and releaved. But because I am now a bankrupt can I still apply to reclaim unfair bank and credit card charges? I understand that I may have to pay half of anything reclaimed to the Insolvency Service (who will then pay it back to the banks, ironic or what!) but as the charges partly contributed to me going bankrupt in the first place I think it only fair that I should be able to.

Can anyone out there help?

Kind regards

Phil

  • I'm no expert,

but if a charge is illegal then its illegal - plus any further damages incurred as a result of those charges.

I would go ahead and try - nothing to loose by doing so.

    Good luck

The answer is NO since the debt was part of your bankruptcy and I think you will need to ask the OR for yourself who will inform you that anything reclaimed will be part of the estate. On a minor point, charges are not ILLEGAL but they might be deemed unlawful ;)
I have not worked for NatWest Bank since February 2009

  • Thanks for the help, I thought that might be the case but it doesn't hurt to ask.
