Advice needed - boundary dispute

Hi
I would like to know if anyone can help me with a dispute over boundaries.

The deeds of myproperty clearly show a that a fence bordering my back garden once belonged to 'London and North Eastern Railway'. Now since they no longer own the land and the land behind the garden is a public walkway, I think it belongs to the council. Is there any way I can prove this?

Advice appreciated, thanks in advance.

    My first port of call would be to the local council and ask them (planning officer)
    I`ve always found that when asked council officials will go out of their way to help.
    Anyway, under the public information act I don`t think they have much choice nowadays.
  • Best bet is to find out when you property was sold off from being a larger plot.

    If when your property was sold off as part of a larger piece of land, indluding the land the other side of the fence, that boundary was not marked with an inward T mark facing into your land then the owner of the retained land retained the maintenance responsibility for that boundary.

    Unfortunately this is going to involve quite an inspection in to your legal title, along with, possibly, that of the neighbouring land.

    i have always found the Land Registry staff to be very helpful when i wanted advice and information about a property matter. It only costs £2 to get a copy of the site plan of the property from the LR site - but this may not give you all the information you need - but a good place to start. You can also get plans for any other property provided it is registered.
  • The Land Registry will provide you with the general position of boundaries. They are not accurate and at the bottom of their plan their is a waiver as to dimensions etc.

    However the filed plan will not have any T marking to denote boundary maintenance responsibilities.

    Thank you all for the advice, it's much appreciated.

    My deeds clearly show a T on the boundary - facing away from my garden to the land owned by the railway. But I'm not sure who owns it now.

    The council are not being very helpful but maybe that's because I'm talking to the wrong departments. I'll keep trying.
