i have an ongoing problem with cabot financial regarding an account i apparently owe on a bank of scotland credit card. This debt has now been passed to morgan solicitors, although in the letter they sent me they claim the account was passed to cabot financial in 2003. They are claiming £3524.53 on this credit card which i have no idea about. I have contacted cabot before now to ask for deatils of this debt ie what address it was taken out from, how long before 2003? And a copy of my signature on the original card application ? I have had no reply to these requests. The letter i have been sent is all legalese but quite threatening. They claim i am obliged to respond to them by virtue of the civil procedure rules 1998. No one will tell me exactly what this debt is, and if it was transferred to cabot in 2003 why are they chasing me for it 6 years later albeit through a firm of solicitiors? I am utterly confused. I have 2 children and a very limited income. How do i find out whether this debt is mine ( i have absolutely no recollection of this card ) and how do i make this all go away?

best thing to do imo is to write to them, deny all recolection of the debt, ask for proof of the debt, ie the orignial cca, statements of the account etc.
send it all recorded delivery, keep a copy of the letter and the recorded del reciept give them 7 days to respond, i dont know if there is a standard letter for this thing so best to search around this forum.
might be an idea to check your credit report also, as iam currently having abit to do with cabot ref a 234.00 debt that they kindly defaulted me on as soon as they purchased the debt from next, so now i have two defaults for the same debt! i have requested three times by recoreded delivery for the orginial default notice, and the credit agreement but ive had no success, ive also asked them to remove the default notice as they have failed to give me the data i have requested and they have ignored that, so there not the best company to get any information from but its worth a go.
if the debt is over 6 yrs old and not on your credit file then it would be statue barred, meaning un-enforcable if thats the case then there would be a letter on here for that.
you say its from 2003, well if thats the case then it may have a few months left before it is statue barred, thus plenty of time for them to enforce it, what month in 2003 is it from ?, if its under 6 years old it wil be on your credit file still.
Untill you have recieved the information you have requested its important you do not speak to them on the phone, admit liability for the debt or offer payment, do everything in writing and send everything by recorded delivery and keep the reciepts, if they choose not to respond iam sure there will be someone on here with more legal knoledge then myself who can help you further, i could also do with that help if anyone would like to assist.
