Hardship case for special needs brother

My brother is 29 but has special needs due to being hit and run when he was about 8. He went to a special needs school and is still clearly not the " full shilling " for want of a better and more politically correct definition. I deal with all his financial needs ( he holds down a full time job ) but he has no financial acumen. I put in a claim for nearly £800 through the small claims court for his reclaimed bank charges, but like everyone else it was put on hold almost 2 years ago. Is there any way I can claim hardship for him bearing in mind he does have a full time job ( albeit quite low paid )? He lives with our mother but pays rent but still has little money to show for his working week. Not sure how, but he seems to lend alot of money to willing workmates who never pay him back ( an unfortunate sympton of his belief in everyone's goodwil ). A difficult situation for both me and him as there is a limit to how much of his financial details i can deal with due to his swinging moods and lack of grasp of reality. Please help.

The way financial hardship claims work are based on priority debt arrears(mortgage/rent, council tax, utilities) and he doesn't have them and has disposable income which would mean the bank would reject the claim on that basis alone. I think you might want to try and get him to write down who he has lent money to or perhaps in the future(how you approach that topic is something I don't know).0
