It would appear that if you resonably beleive that the equipment will be used to watch live broadcasts then you need a licence!

You need a licence to WATCH or RECORD live TV - that is all !
All the previous quotes from the Communications Act are just muddying the water. Quoting bits of this Act in isolation are meaningless.
TV Licensing's favourite "confuse the customer" one is the statement they keep pushing out saying that it is an offence to "install a television" - then later on in the small print they add "with the intenion of watching it without a licence".
Just ignore them, they can't come in, they cannot make you talk to them.
If they do turn up, just say you are withdrawing their "presumed rights of access" (that's what the milkman has) to your property. If they don't leave or if they come back you can sue them !0 -

Quoting relevant parts of a UK statute is the usual way of showing an offence has been committed, or it was the last time I was in court.
Perhaps, rather than making sweeping statements, you could explain why an Act of Parliament does not apply to readers of the MSE forum?
The Act is quite clear, that installing the eqipment is an offence, there is no requirement to use the equipment. If you can give a cogent reason why this is not applicable then your protestations might carry some weight.
Otherwise, it may be better to give the correct advice, which is easily followed, of de-tuning the equipment and informing TVLA of the fact.0 -
If your TV or video is tuned in to channels then you need a license, if it is not tuned in to channels then you don't. In your case your TV is broken so there's no need for a license.
I bought a USB tuner for my laptop at uni and they sent a letter round. I phoned them up once to explain it was portable and my home license would apply and they never contacted me again.0 -

Could you just get down off your high horse for one minute.
I had a long "battle" with TV licensing for over a year, which involved the local area office and my MP, so I can claim to be fairly au fait with TV licensing.
I will agree with you that the 2003 Act does say that it is an offence to install a TV without a Licence - however the BBC and TVL who "enforce" the Law state quite clearly:- "You need a TV Licence to use any television receiving equipment such as a TV set, digital box, DVD or video recorder, PC, laptop or mobile phone to watch or record television programmes as they're being shown on TV" - NOT to install
The BBC re-confirmed this in response to an FoI request on 14/03/07. (My highlighting)
You do not need a licence to watch pre recorded programmes on your TV.
This is because a previously recorded TV programme is outside the scope of the Communications (Television Licensing) Regulations 2004, because it is not "received at the same time (or virtually the same time) as it is received by members of the public.
You DO NOT need to de-tune the TV you certainly DO NOT have to inform TVL of anything.
What actually counts is HOW the Law is enforced, I believe it may still be the Law for all taxis to carry a bale of hay to feed the horse - but not many prosecutions recently !

Truth is, you don't need a license unless you watch LIVE tv broadcasts.
If anyone tells you otherwise, they're lieing or can't read a simple webpage without it muddling their mind.
If you contact them, all they will do is start sending you letters with your name on them.
HTHIt could have been worse. At least source code's not combustible, or you can bet somebody at McAfee would have lit it.0 -

Or you could have saved yourself a year long battle by complying with the statute and de-tuning the TV and Video.
So, to conclude - my advice, technically correct and involving almost no inconvenience, or your advice, technically incorrect, involving long battles and letters to MPs.
Also, there is no law in force requiring taxi's to carry a bale of hay. People will believe anything they read on the internet!0
