Endsleigh car insurance - trying to charge me for their mistake

Excuse my lack of info and punctuation as I am in an Italian Internet Cafe right now (which Im sure is dodgy...)

I renewed my car insurance with Endsleigh, got it down to £1277 (good for a student), and paid for it. When I renewed I specifically changed two things on the policy - that the car would be parked on the street overnight and not a garage, and that the annual milage would be 5000 miles and not 2000. When I checked the statement of insurance online however, it had not been changed.

One long complaints process later, and they completely admit that the person I spoke to made a mistake, but they claim that there was no comission left on that £1277 for them to waive the £135 it would cost to change the policy, and that because THEY are within the 14 day cooling off period that they can cancel the policy at any time (the policy starts in a week btw, so 21 days remaining). So either I pay the fee or I get to cancel.

At that point my Dad took the phone and gave them a shouting at (namely that the 14 day cooling off period is only for the benefit of the consumer, something I didnt know), and told this guy to ask his line manager one more time to get the £135 waived. That was yesterday, still waiting the call.

Now I know the process, if they fail to resolve it then we go to the ombudsman, etc. However I was just wondering if anyone knew for certain whether or not Endsleigh are legally in the wrong here, and if anyone had any other advice? IMO, a contract has formed between me and Endsleigh, and they cannot cancel using the 14 day cooling off period as that would come under the unfair contract regulations.

I probably wont be back for about a week, so thanks in advance for any advice.

    Dad's shouting at insurance staff will probably just harden their heart!

    They made a mistake. You have no rights over this, all you can do is just hope they help you as a goodwill gesture. In the meantime get searching for an alternative company.

    first mistake was actually paying endsleigh to ensure your car!

    id cancel it and go elsewhere!

    i remember having two non fault accidents and it took them 8 weeks to settle on both cases. then they refused to give me my no claims! argued to hell and back and did eventually get my no claims re-instated!
