PLEASE HELP!!! :mad: I have been a member of my gym for 3 1/2 years and when i joined a took out the full membership which entitled me to use all facilities including rackets. Suddenly they have reviewed peoples memberships and have decided that i am not entitled to this and want me to upgrade and pay an additional £18 per month!!! After numerous failed attempts to get some answers i was eventually told that at the time when i joined the membership team were misselling full memberships and had been doing so for approx 6 months
and that this is what has happened to me. They also kindly informed me that i am now no longer entitled to book any racket courts unless i upgrade my membership? Im guessing that they are trying to get away with this but i want to fight it and im guessing im protected by some law or policy but im not sure what? Im in the process of writing a letter and would greatly appreciate any advice on my rights that i can throw at them to stop them getting away with it?? thanks

It depends on what the text of your agreement states. However I wouldn't be surprised if it also says that they can vary the terms of the agreement at any time.
However since they have made a significant change in your contract with them, you'd be entitled to cancel it without penalty.0 -
I agree with Mark - there's normally some sort of clause in the contract stating they can make changes, but as this is quite significant, they should allow you to cancel your contract with no penalty.
If they insist you pay until the end of a 12 month contract, then insist they provide the service you signed up for.Should've = Should HAVE (not 'of')

I know what you want is to be able to use the facilities at the original price. But, you can't! Companies can and do change their pricing structure, it's entirely up to them.0
