Hardship Ruling

Hi,
I dont really understand the hardship ruling for reclaiming my bank charges from Halifax.
Im currently employed and haven't incurred any charges recently but am still living on my overdraft, and am struggling to get clear of it. I also have a fairly hefty credit card bill.
Do i qualify under the hardship ruling. Any advice will be very welcome!!!!

    There is no hardship ruling as such. There is a stay on all claims but the FSA Waiver on Bank charges has one exception which is Financial Hardship.
    However it is defined as priority debt arrears(mortgage/rent, council tax, utilities)?
    There are elements of fianancial hardship you have ie loss of employment but without priority debt arrears you may find it difficult for the bank to payout anything.
    However start your claim today as you can go back to July 2001.
    I have not worked for NatWest Bank since February 2009
