Sounds like a tricky one! If he lived alone and was working full time he would get 25% off the total council tax, but as there are two of you in the house claiming benefits I dont know how it would work - I would have thought he will pay less than that still but not sure!

You could always try asking at your local Citizens Advice Bureau.

If he is still living with you he will then be a non-dependant and a "non-dependant deduction" will be taken from your Council Tax Benefit & Housing Benefit. This is worked out on a scale depending on his income and you will have to ask him for this amount. If he is on a good wage it is a very unfair amount. For details contact your local Citizens Advice Bureau. There are some exceptions when he wouldn't have to pay but being in full time work he is likely to have to. Have a look on your Council Tax Bill, sometimes they list the amounts deducted (it depends on your council). The non-dependant deduction is unfair in that it puts the onus on the claimant to collect the shortfall from the non dependant.

  • Fran is right, there is a non-dependant deduction. Your local council benefits office will tell you. It is worked out on a sliding scale, you will need to find out how much your son is earning gross & provide them with copies of his payslips. Is he in an Apprenticeship of doing a full time/fully paid job? If he is an Apprentice, the rules are different. It's best to tell them asap otherwise you end up with a hefty over payment which is never a nice suprise.

Roughly how much does your son earn per month? If he gets £1000 a month he will be expected to pay about £38 a week! This is nothing really considering if he had to move out he'd be paying much more than that in rent. I.e if your son is still living at home when he's 18 and you are on benefits he should definitely be making a contribution towards those living costs.

Housing Benefit only contribute to under 25's if they are sharing accommodation with other people (room in a shared house) or have children themselves. This does not include parents/families properties...but privately rented etc that they have gone out and found.

Make sure you include your son as a non-dependant once he's 18....if you don't do this and get caught out you may face a stiff penalty.
