Deposit Protection Scheme

Hi all,
Not going to drag this post out so will keep it short.
I currently rent a flat and due to move out at the end of this month into a rented house, however our landlord has been round recently doing viewings of this flat and has been picking up things that he is going to deduct from our deposit, which he shouldnt be doing yet anyway. Anyway the way things are going we wont get any of our deposit back but having only recently found out myself about the protection scheme i know full well he hasnt paid it into one....so where do we stand? Does he get to keep the deposit and there is nothing more we can do about it or do we have any rights in the fact he has broke the law by not paying into the scheme?

if you search on this site and also on www.landlordzone.co.uk you will come across many many threads on deposit scheme.
the crucial question is - when did you last sign a tenancy agreement ?0 -
12 months ago. I thought there may be alot of threads, sorry to be a pain0

a) He must have protected the deposit.
b) If he hasn't he can be fined 3xdeposit & have to return deposit (less fair deductions...)

and suggest he gives you the full deposit sharpish and you will take it no further,,,,
Alternatively, if in the mood for a fight, decline any offers of money & sue him for the 3xdeposit. (ie don't cash any cheque ...)
Further you do not have to allow viewings (or any other visits by LL). Just write saying no more viewings/visits without your written agreement, in advance... as a lever to get the full deposit...
Yet further, you do not have to keep property tidy: If you wish to live like a pig that is your (almost) absolute legal right...
