Consumer Rights & Refurbished Goods

Hi there,

This is a bit of a tricky subject and I'm not entirely sure where I stand. I'd appreciate any help or advice you can offer.

My parents very kindly bought my partner and I a Sony Bravia HDTV a year and a half ago from this website (http://www.electrical-deals.co.uk). The items are sold as being "factory-graded" and "refurbished".

Last week the TV started acting up, the picture flickering and cutting out, and the sound replaced by a loud and startling popping sound. It's been unplugged since then.

My Dad phoned up the people who sold the telly and he was told that since it was sold as refurbished he has no right to ask for a repair or replacement.

I don't think 18 months is very long for a telly to last and I'm not sure what our rights are in this instance.

    Rights under Sale of Goods Act continue to apply unless specific defects have been pointed out at the time of purchase. However, "satisfactory quality" may have a lower meaning in respect of this sort of thing. The faults you mention would, in my view, cause the unit to fail to comply.
