am i entitled to removals at public expense

long story ill cut short my daughter has a significant speech delay and the peaditrican has requested me move back to the uk. this is now sitting with jpac and no one will give me clear answers. i have had to provide that the local authority will be able to provide help for her which i did and still waiting answer i cant afford removals back from germany.
what are my chances of them authorising and what other options do i have to get my kit back.

You need to give a bit more info.
Are you married?
Are you military or dependant?
If military will you be posted as result of move back to UK?
Is your daughter living with you at the present time?
Is the peadiatrician military and have you gone through the military medical channels?0 -

yes i am married my daughter lives with us my husband is currently on tour and waiting for posting to uk on return.
this has all been done through the army peaditricans and medical channels and welfare officer.
I will be returning to my own house not a married quarter so dont know if that is causing them problems0 -
So long as the family dependants are moving back you should have paid removals - your OH will then, presumably, be living in the block as unaccompanied (post-tour) until he gets posted back?
If you have concerns, I'd get the AFF (Army Fam Fed) involved now. I'm sure you can do without this added stress.Mortgage Free thanks to ill-health retirement0 -

i feel with these uwo they dont really give a sxxt its all brownie points for them and make u feel that your a nusiance calling them.

The AFF will help you fight your corner if the established welfare system is being illogical. Please call them/email them - there'll be a local person out in Germany, hopefully not far from you, as well as the main team back in the UK. www.aff.org.uk, www.aff.org.uk/aff_germany.htm, [EMAIL="germany@aff.org.uk"]germany@aff.org.uk[/EMAIL]

The problem is, the way i am reading the rules, because your husband will not be moving back with you (i guess you are saying that) you are theorectically not entitled to be moved at public expense as i guess they are classing it as a move for non-servce reasons.
Moves for Non-Service Reasons. Moves made for non-Service reasons are not funded at public expense. Service personnel who opt to move accommodation mid-assignment for personal reasons, including first setting up home, are not entitled to a mid-assignment move of PE at public expense, except for the first move after break up of a marriage or civil partnership. In all other circumstances, authority for mid-assignment moves at public expense on compassionate grounds may be requested through JPAC Pay and Allowances Casework Cell (PACC).
You say your husband is awaiting a posting on return from out of area, how long is that away and is that a definate posting. If so cant you just move back early and then get your husband to move back with the furniture? or even hang on out there until his posting comes through?0 -
I am going to speak to the uwo again today and want them to chase jpac.
as for staying till my husbands posting comes through that is not an option the services out here an inaquate and why should my daughter suffer any longer without the correct support, hence the reason we have made this decision with alot of blood sweat and tears.
if worse comes to the worse ill say that i am seperating as my daughter comes first not the army.

I am in the RAF and the info can be found within JSP 752 chapter 7 section 2 for movement and storage of personal effects.
The problem you have is that yes, you are requesting to move back on a compassionate reason BUT because your husband is not going to be moving with you on compassionate grounds this is where the problems have started.
I will post a couple of paragraphs to try and explain it a bit better but at the end of the day it will come down to hoping you get a sympathetic person.
JSP752 Chapter 7 Section 2
07.0205. Eligible Service Personnel. All Regular Service personnel and Military Provost Guard Service personnel and, where appropriate, their accompanying immediate families, are eligible to move and/or store their entitlement of PE at public expense when one of the following is met:
i. They are required to relocate their immediate family due to an enforced mid-assignment move as detailed in Section 1 to this Chapter. This provision is directed primarily at Service personnel who are required by DHE, or equivalent, to move accommodation. This movement of PE is liable to tax. Service personnel are not entitled to a mid-assignment move of PE at public expense when Service transport can be made available to facilitate the move.
Going on this paragraph all would seem done and dusted and entitlement is granted.
BUT you have to refer to Chapter 1 (which is the disturbance allowance section) to be eligible.
JSP752 Chapter 7 Section 1
07.0116. Qualifying Moves. It is the move of the Service person, not the immediate family (unless bereaved or in the circumstances at paragraph 07.0118), which provides eligibility for DA. To qualify for DA Service personnel must:
c. Undertake a mid-assignment move for Service reasons, as a result of a change of Service accommodation entitlement (other than as a result of first setting up of home), or for compassionate, welfare or medical reasons when authorised by SPVA Pay and Allowances Casework Cell (PACC).
So the way I read into it all is as it states in qualifying moves, it is the move of the Service person, not the immediate family which grants the eligibility unless authorised by SPVA Pay and Allowances Casework Cell (PACC).
If you go down the route of separating with your husband then yes you are then entitled to a move at public expense.
