Speeding fine advice needed

Is it possible to contest a speeding charge of doing 35mph in a 30mph zone?

    Of course you can contest it.

    For the sake of a couple of hours in a speed awareness course is it really worth it though??

  • you could. i know the police allow 3mph over, incase your sppedo is slightly in accurate. i would if i were you, nothing to loose.

    Hi, most police websites show a threshold of 10% + 2 , if you had been under 35mph it would have been worth contesting it , however if you go to court when you are clearly over the speed limit sometimes they treat you as wasting the courts time and may increase the penalty - is it a risk worth taking?

    The point is, did you know you were pushing the boundaries with the speed limit? If your speedometer was wildly inaccurate, you'd have to prove that. Speeding is an absolute offence and once your speed is proved, you're guilty unless you can show you were driving a police, ambulance or fire vehicle and complying with the limit would be likely to hinder that vehicle for that purpose on that occasion.

    Your only hope of an acquittal on a technicality is if you can prove that the speed measuring equipment used on that occasion was faulty, uncalibrated or unapproved. That burden of proof is on you.

    And what good would proving the speedo inaccurate do?:confused:

    Like you said speeding is an absolute offence so the OP would still be guilty.
