Help, i need some advice. Had an accident on the exit of a round about the other day.
Situation was..
Came up to roundabout at about 15/20. It was clear for me to go but i could see a boy racer fiesta just about to pull out of the juction to the right of me.
As i already had momentum i knew i had loads of room so carried on, the kid didnt like it that i had pulled before he had chance to so came flying up behind me so close he nudged me. I have then braked and he has hit me again.
I pull over, he has his mum in the car hes trying to blame me, saying i pulled out on him then his mum says i braked to hard..
I am so annoyed, i have been driving for nearly 8 years without any accidents and now i have the chance of losing my no claims as he his not accepting liability. Hes saying i pulled out on him but he has hit me clearly in the rear, at the time he was taking the mic out of my mums car - seicento and i think he was just showing off. Although as it was my mums car and i was driving it on my extension i only have third party insurance and therefor they will not get involved yet..
help!!
Jamie.

You need to inform your insurer so that they are aware of the circs if/when the third party or their insurers contact them with their claim.
You need to make a claim against the third party insurers (as you only have third party cover) - or if liability isn't accepted stump up for the repairs yourself.
If you do end up losing your NCD it will only be 2 years worth.0 -
He drove into the back of you, so he is liable."You were only supposed to blow the bl**dy doors off!!"0

I think you are in the wrong personally, you saw him and still pulled out and then you braked after he nudged you. But as he went into your rear the insurance will probably side with you as that is normally a pretty standard rule.0

In normal queing circumstances, this is true.
However, he has -hit- the back of her, not -gone up- the back of her (as you would in traffic)
**DISCLAIMER** THIS NEXT PARt IS NOT A REFLECTION ON THE OP'S DRIVING AND IS MERELY AN EXAMPLE SITUATION**
In this situation normally, it would appear the driver who has been hit (car one) has emerged from a junction that they should have given way at; The car who hit car one (car two) would have already been on the roundabout approaching from the right, and as you are supposed to give way to traffic approaching from the right, car one should have yielded and allowed car two to pass before emerging. Therefore, because they have emerged too early and although they have been hit across the back, it is still car ones fault.:j [STRIKE]Debt Free[/STRIKE] Savings Wannabe! :jCurrent problems: £107 overdrawn in bank, £112 in unpaid DD'sSavings made: £00 -
So was boy racer actually on the roundabout before you pulled out? To me the boy racer is at fault, even if you pulled out too late he should have been going slow and careful enough to stop in time, and if he didn't brake enough after nudging you once and hit you again then it sounds like he wasn't paying much attention. If someone nudged me my reaction would also be to brake.0

Is there any way i can show you all a picture of the scene?
I have completed my insurance accident form, although they say there is nothing for them to do as it is clear cut that he has hit me. Although they have not asked me to draw any pictures etc
How will i only lose 2 years ncb?
thanks

we hit the roundabout at the same time really, he came screeching out of the junction right up behind me, i was watching him in my rear view mirror.0 -

Kind of, an unmarked car see me shouting at the boy and his mum so pulled over. Just said to swap details and go home.0 -

If your insurer ends up paying out anything to the third party then your current level of NCD goes back 2 years per claim.
So if you have the maximum now (5 years), then at renewal you will still have 3 years NCD after this incident. This is how the insurers apply their scale following a claim. If you now have only 2 years or less NCD, then you would have zero at renewal.
But if you are not deemed to be in any way at fault, then your NCD will be unaffected (as your insurer won't have to pay out for any repairs at all).0
