Holiday Quote

Last Thursday I was given a verbal quote over the telephone from a cruise company for a cruise for 2 adults and 2 children. I questionned the quote on 2 occasions during the conversation but was assured it was correct. I went ahead and paid the 10% deposit over the telephone by credit card. On Saturday morning I had a telephone call from the cruise company (the same person who I spoke to on Thursday) and was told that they had made a mistake and that the total cost was another £4000. I want to know whether I am able to refuse to pay this extra money as a verbal agreement had been made for the original amount and I have paid the 10% deposit?

My inital thought was that if the call was recorded you have a legal right through the Data Protection Act to request a copy of the tape - this being your contract. They are able to charge you a 'nominal' amount for the administration of this request.
Further thought though in the t&c's of the contract there will probably be a clause whereby they have the right to cancel your holiday and refund the monies you have paid.
Not much help, but in my opinion, i would get my 10% back and look elsewhere.0 -
A similar thing happened to us a few years ago. We were quoted a price for an AI holiday (which soounded too good to be true), we checked the price a few and was told yes it was correct. We therefore went ahead booked the holiday and paid the deposit. The following day we had a telephone call stating that the price they had quoted us was for halfboard and that it would be an extra £400 for AI. I explained that I had checked this and the printout given to me by the Travel Agent had AI on it, I felt they should honour the price as I had paid the deposit. They said their T&C allowed them to either correct price (extra £400) or cancel the holiday and refund the deposit. They eventually agreed as a gesture of goodwill to split the extra cost 50/50. Maybe you could negotiate something similar. I did check their T&C and they were allowed to do this.0

did we not have a similar thread not long ago when this happened with global??? was the outcome not that they got trading standards in and global had to give it at the price quoted???
