    6 months after the original letter/hassle/demand for proof they have been in touch again.

    We have heard nothing at all since I last posted on this thread. This morning I open a letter to 'The Occupier' from these numpties, with a freephone number and no other information.

    Once bitten etc, guess we won't be phoning them then ;)

    Chancers or what!!!!!!!!

    Letter now filed in file 9 (the bin). Anything further will be ignored.

    Well you've got grounds for complaint to the FOS if you want. Compensation is possible.

    There's a thread here that sets out the procedure.

    They have breached OFT Debt Collection Guidance 2003:

    2.8a Examples of unfair practices are as follows:
    sending demands for payment to an individual when it is uncertain that
    they are the debtor in question, for example, threatening debt recovery
    action to 'the occupier'...

    2.14b continuing to press for payment after a debtor has stated that they
    will not be paying a debt because it is statute barred could amount to
    harassment contrary to section 40 (1) of the Administration of
    Justice Act 1970.

    s40AJA has been superceded (see RAS's letter, post #3) but the principle remains.

    Copy any complaint to OFT, CSA (Credit Services Association) and Trading Standards (Consumer Direct).

    But you'll need to retrieve their letter from File 9 :)
  • Darn, didn't realise that :( It went down to the file 9 large storage facility last night (i.e bin has been emptied outside). Well if they do it again, I'll have a go at that.
