Hi there
This is my first post here, so bear with me.
have had my first 'pleasant' conversation with a lady claiming to be called susan from this company today. What a honey:rolleyes:
Anyway, background.
About 2 weeks ago we received a to the occupier letter. Foolishly I contacted as I had no idea they were debt collectors. they then sent a letter, which arrived the day we left on holiday claiming to be working for cabot and asking my husband to call them. Now he had a lot of debt about 10 years ago but these have all been dealt with. he thinks this one goes back to then. We had heard nothing from the company for about 9 years.
Within the week he recieved another letter saying they were going for bankrupcy. When we got home to find this, he contacted the CAB who told us to send a statute berred letter and ask for written clarification that this was inded statute barred. I used the template off the uk debtline site, which carefully alluded to alleged debts etc.
Today i answer the phone to this lady wh starts demanding my husband's mobile number. I ask who is calling, then tell her that we are only communicating in writing. She then became aggressive and trying to shout me down whenever i repeated this so I eventually hung up.
30 seconds later she called back, teling me that I wasn't helping, that they only send certain letters out and that she would note on the records that I refused to take a message and hung up on her ( which strangley she refused to leave in the first call). I continued with my 'in writing speech' and she shouted that I wasn't helping, that there would be no more comunication, and they would now 'proceed'
Did I do right?
I'm now a bit worried that I've made things worse, but the way I see it, its not a jointly liable debt and its statute barred. She surely can't proceed with anything as she hasn't contacted the alleged debtor. We also have a copy of the letter we sent which states we wabted a response in writing.
should I worry, or should I just ignore anything further from them.

Hi
Ruthbridge are a nightmare.
You are absolutely right to refuse to speak to them. Have you sent the telephone letter?
If the debt is statue barred and you have sent them a lette rto that effect they are breaching OFT Guidelines by continusing to chase the debt. THE OFT have put another DCa into special measures for doing the same thing.
I suggest that Monday morning you make a formal complaint to the OFT and to the Trading Standards closest to Ruthbridg'e office.
They do not act on single complaints but they log them and use them to monitor their license. If you've have not made a mistake, you've made nothing0 -
are a lot of different response letters for harassment by telephone floating around. This is just one example posted by fermi:

Dear Sirs,
Harassment by telephone
Account Number: XXXXXXX
I am writing in relation to the quantity and frequency of telephone calls that I have received from your company, which I deem to be personally harassing.
I have verbally requested that these stop, but I am still receiving calls. (Delete if necessary)
I now require all further correspondence from your company to be made in writing only.
I am of the view that your continued harassment of me by telephone puts you in breach of The Consumer Protection from Unfair Trading Regulations 2008, and the Protection from Harassment Act 1997.
If you continue to harass me by telephone, you will also be in breach of the Communications Act (2003) s.127 and I will report you to OFCOM, Trading Standards and The Office of Fair Trading, meaning that you will be liable to a substantial fine.
Please treat this also as a formal complaint, and send me a copy of your company complaints procedure.
Be advised that any further telephone calls from your company will be recorded. (**Even if you don‘t yet have recording equipment!!**)
Yours faithfully,
(type don't sign)
Send it registered post so you can prove they got it.If you've have not made a mistake, you've made nothing0 -
Remind them of the watchdog program in feb, its upto them to prove as per the oft guidelines0

Thanks, you've put my mind at rest.
Yet more scare tactics from these chancers then :rolleyes2
The more I thought about it, the more I realised she was chancing her arm. Nothing I say has any relevence as its not my debt. In fact she really shouldn't have phoned me back to argue the toss as it not my debt.
I'll send the phone letter if she calls again, although she claims there will be no more contct (we will see)
I'll find out there nearest trading Standards place too;)0 -

Well, guess who phoned again yesterday
They now allege hubby made a payment in May 2008 - no he didn't - his grant wasn't there then, I would have to have paid it for him. Still not got the proof in writing though.
Hubby was nice and calm, told them he had taken advice and was still waiting for a reply to the letter and he disputes the payment.
Get this they will send him the proof But in the meantime they will advise that the client (don't know if this is Ruthbridge, Cabot or MBNA now;)) now starts legal procedings. :rotfl:
Er.....dispute, timebarred etc... WHAT legal proceedings? Same ones you were going to take 5 weeks ago?
Hubby told them to go ahead, as long he they sent the proof that he had paid them IN WRITING.
We've spoken to CAB plus the advice from here, so we are going to brazen them out.0 -
If there was anything like the slimmist chance that these cretins had any legitimate right to collect on this alleged debt, then Cabot would be doing the chasing themselves.
They seem to think that by farming unenforcable debts out to these mental midgets in Ruthbridge, then they are distancing themselves from any illegal activities that take place. They are wrong.
I would write a strongly worded letter to Assistant Legal Council in Cabot, Willem Wellinghoff, that if they don't tell Ruthbridge to cease their criminal harrassment, then any legal action you may take will result in Cabot being called to account for their culpability.

Kent ME19 4UACabot can now kiss my DONKEY. Statute barred is enough of a result, but the actions of the CABOT FAN CLUB have cost them far more than the paltry sums they were chasing us for. :beer:0 -
Thank you for that. Might just do tht. Also going to contact oft about them.
They are a bunch of arrogant, rude, chancers0 -
If you complain to the OFT, make sure you explain that they are acting under instruction from Cabot Financial (Europe) Limited.
Why not save a stamp, and email an angrygram to Mr Wellinghoff? Copy it to the CEO as well, Mr Ken Maynard.
