Consumer rights issue

Hi guys,
Not sure issue if this is in the right place but i have a consumer rights issue and am after a bit of advice. Here goes.....
We booked a hotel in April at a hotel in Folkestone through a well known Booking website. No probs with booking but family emergency meant we had to cancel at approx 36hr notice. Confirmed with hotel via telephone and told no problem and we wouldnt be charged as we were giving more than 24hr notice.
On the day of the booking the hotel contacted us at about 6pm to say that we would be charged and the hotel were in error to tell us otherwise.
After complaint we were offered the chance to transfer the booking to another night of our choice. We agreed and moved the booking to tomorrow night with no extra cost.
Just got a call from hotel to advise that we would be charged an extra £40+ on arrival due to peak season. I complained again and was told that nothing can be done. Now faced with 2 options. 1) have refund and fork out on hotel at late notice and pay approx £30 more or 2) keep the booking and pay the extra £40+.
The hotel have offered upgrade (despite saying earlier that they were full) but we cant afford any more money.
Anybody have any advice.
