IVA affect tenancy application
Options
Hi all,
I'm about to apply for an apartment through a letting agency, and on the form it asks if i have any adverse credit history... which i do. I had an IVA but it fell through when i couldn't make payments.
Is this going to be a major problem do you think?
Thanks

Before I answer, can I ask... What did you do when the IVA failed? Have you entered into an informal arrangement such as a debt management plan, or have you declared yourself bankrupt?
I think the answer to this question will help determine how you should play it but, from my experience, there is no really clear answer to this unfortunately.
It seems some letting agencies aren't too interested in IVA's yet others are, and the same with bankruptcy. Suffice to say, a sizeable deposit will normally satisfy them, assuming you can afford one.
You might get a better idea by posting your question on the bankruptcy board, where there's more feedback.

I haven't gone bankrupt or entered a DMP, most of my creditors continue to send me letters asking for payment. Some creditors I haven't heard from since the IVA failed (which was nearly a year ago).0

It would appear you have 2 choices, either to be truthful, and mention you have adverse history - but don't give them any details, or you can tell a porky and say you have no adverse, and hope they don't check.
For what it's worth, my advice would be to be truthful. I'd answer the question with Yes.
Can I ask you why you haven't dealt with the fall-out from the failed IVA yet?
Do you intend leaving it in the hope that it will just disappear? If so, you need to reconsider your decision, because until you deal with the situation head on, you'll always have to deal with issues just like this.
If I were you I'd have a look around the bankruptcy board. I can guarantee there will be someone who has been in your situation that will be able to advise you about what to do next, and get the whole mess sorted out.
good luck anyway,
