when you say "they" do you mean your partner and his ex or Tax Credits...? technically she shouldn't be able to claim for him as someone else is (i.e. your partner....?)
fill out the appeal form and send it off..... try asking to speak to a supervisor when you call up instead of the person that answers the call... The people in the call centre really only ask for the boxes to be filled they appear not to be able to deviate from the norm..Lightbulb Moment - March 2004

The Tax Credit Office have now sent the same documents agains with the overpayment and another to say about repaying it.
I don't understand we were told to resend my fiance's declaration by 31st July which we did way back in April and have heard nothing till now when they send the same thing all over again!??!

Am i mistaken or have i read correctly that both parents are claiming CTC for the same child? Erm hello, surely this is plain and simple or am i missing something blindingly obvious?
Your Ex should not have put your child on her CTC form for her new child. In doing so she is then getting the award for her/your child.
Hardly seems fair to me anyway. CTC is a hell of a lot more than CB, so it would never have been fair on her.0 -
mitchaa you have misread, the mother gets child benefit and the father gets child tax creditsI am not bossy I just have better ideas:p0

I read that as his ex applied for CTC for her new baby and added the 2nd already claimed for child onto that form.
If this is the case then this is the answer.
I see no link to her adding a 2nd child onto her already existing CB form, but i do see a link of putting a 2nd child on a new CTC form as you cannot claim twice for the same child.0 -
I need some help. Last year TC said i owed them £1200 from the tax year 2005-2006. I have had less weekly payment for the last tax year. To repay this back,bearing in mind it was 3 years ago.
After hearing about being able to claim CTC, i called them to claim back cost i paid in 2007. They said they have a time limit of 30days. As i am out of this time i cannot claim anything back. Howcome they can claim back after 3 year but we only get 30 days. Does anybody have any advise as to were i should go as i really don't think this is fair or right.

There's 2 different things here.
Firstly they overpaid you for some reason in 05/06 and they are within their rights to reduce your payments to claw it back. The overpayment would have been mentioned in the finalised award notice for 05/06 and you would have been advised of their intention to reduce your payments. You however are equally within your rights to dispute this overpayment if you think it is their fault or it is just wrong.
Secondly all documentation sent out by TCO advises you to inform them as soon as possible of any changes in your circumstances. That includes household breakdowns, change of employment, unemployment, birth of children or new children coming into household, children leaving education, and having to pay childcare costs. Unfortunately the government have, as a matter of policy, imposed a time limit for informing TCO of those changes and if you don't then it is your loss. They have joint residency and we were sent a questionnaire by HM and sent that back pronto with my partne's declaration way back in February.
In April my partner got a letter saying his child tax credits have been stopped and he has been overpaid by just over £1000???!?!
We got straight on the phone, they were very unhelpful and said they had never received his declaration which is so wrong as we DEFINATELY sent it back so they sent out another declaration, we filled it out and sent it back pronto via a Recorded delivery.
We have yet to hear from them and I'm wondering what to do?
We can't afford to pay them that money but more importantly its wrong he doesn't owe that money and he should still be being paid CTC!
Any help would be so appreciated HM is hard to deal with!
What declaration did your partner have to complete in February? The annual declarations normally have to be submitted by 31st July.
You need to send a letter by recorded delivery to TCO asking for a full explanation of how the overpayment arose. Once you find out the reason you can then formally dispute the overpayment.This is a system account and does not represent a real person.
