Help please - bank charges

I helped my son make a claim against a bank for overcharging - up to July 07. (still waiting) It now turns out that he was tipped over his overdraft last year - by bank interest charges and since then they have been levying charges and interest every month - and he dosen't use the account! It was because he got a letter from the collections arm of the bank! - we have asked them why they have carried on doing this and we were told to ask them to freeze the charges - when we called they said no - and that he had illegally gone over his overdraft limit - which is not true - it was they who tipped him over!
Any help with how we can get this stopped?? Do I need to do another claim from 2007 to the present?
Help!!!

    Pay off the overdraft. Sorted.

    The charges'll keep coming until you do, and if you can claim them back, you'll claim them back in good time.

    Thanks - we have paid it off - and they managed to add another £75 as we did it!
    I shall now put in another claim for the further charges incurred. I just wanted to know if it had happened to anyone else? Can we do this?
    My son left his account under the overdraft limit - so although he got statements he did not bother to open them (yes I know stupid). He had an interest charge put on last November by the bank - which then tipped him over his limit - as he has not used the account he did not see the need to check them and they have been adding bank charges and interest all this time - in fact his debit card was not even registered for the account when we went to the branch to try and sort it out!!

    So he was in his overdraft but none the less he was overdrawn, I note you didn't mention any figures so just as an example he could have had a £1k o/d and left the account £999 pounds o/d, when an o/d is a temporary measure do you think it's fair to leave that money outstanding (expecting to pay Zero for it) and start using another banks services?

    was listening to todays 'Money Box' on R4 earlier, seems this is by design. These banks\building societies get you in a position whereby you're in debt, then followup with various other penalty's which are according to the FSA are possibly unaceptable, providing they can find proof that such a thing is happening. Apparantly, they ask the various institutions to PROVE they make such demands for payment, and when they fail to deliver the evidence. They take it as fact that they're not doing it! Poor woman on there, if I was hearing what I thought I was hearing must enjoy looking stupid, hope se's well paid for it, though I suspect she is.

    So from what she was saying, they're penalty payments which are essentially illegal and therefore should be challenged in just the same way as any other penalty payment: SAR, Small Claims Court etc IIRC. So to the 'Bank Charges' forum with you.
