Reclaiming Bank charges after death?

Hello all. My mother recently died. Shortly beforehand we were planning to start the process of reclaiming her bank charges. As the executor of her estate, can I continue the action or has the opportunity now passed?

    The answer is yes, however you cannot ask for a subject access request since the subject, ie your mother has passed away. Before going further forward I want to add my condolences to you. I would suggest that you take time out of all of this to grieve. The first thing you need to do is request bank statements ie copy statements since 27th July 2001 or since the account was opened if later. Next thing is to calculate the charges on the account and write to the bank for the money back as executor of the estate. The bank will acknowledge the claim but will not pay out until after the OFT test case is over. There is no recourse to hardship since she has passed away but they will pay out if they lose and this will be part of her estate.
