Deadline for paying me all my notice pay and stat. redundancy pay

Hi
Would appreciate any advice anyone could give.

I have been made redundant after 7 years of service. My redundancy started on 22 June 2009 (my first day back after maternity leave.) - but this is not the issue as I had been warned this may happen if nothing suitable could be found. I am entitled to 7 weeks notice pay (from 22 June), some holiday pay and statutory redundancy pay. When my boss started talking about potential redundancy back in January he said he would prefer to pay me in a few instalments due to cash flow problems. I agreed, trying to be helpful. Nothing was said or written about how many instalments at the time.

I have now received my formal redundancy notice and basically i'm going to be paid in 4 instalments, starting in June (i've been paid this), then July, August and September. My notice period would have been long completed by this stage. Is it just me or is this too long? From a legal point of view, is there a maximum time frame within which he has to pay me? I know i don't have dire cash flow problems luckily but I don't think that's the point. Is there anything from any govt website that i could refer him to for example? I have to be careful how i approach this as my boss the MD (and there are only 2 employees in the company) is providing my reference and he may make me work some of my notice period depending on his mood (if i ask to reduce the number of instalments).

Many thanks in advance for your help on this one.

What does the termination letter say about notice?

Does it say PILON if it does then he cannot then ask you to work the notice.

If it just says your last day is xxx then he can ask you to work up till then as long as that gives the correct notice.

I think notice should start from the date of the termination letter not before, they can't backdate notice. To set the notice start date at the 22 then they must have given you notice in writing on or before the 21st.
(When paying PILON the date does not matter termination can be the next day so effectivly immediate)

The notice starts the day after the date you recieve the letter so it it was a Monday that would be 7 weeks from the Tues.

It is common for the payments to be done at a normal pay time.

So in your case you would have been paid the extra around mid-end August if working notice.

So it looks like you are getting 1/2 the redundancy early 1/4 on time and 1/4 one month late(1/4 of the redundancy+holiday, mormal pay should not be late) so I would not worry about this.

7 weeks stat is £2450max(asuming between 22 and 41) cash flow must be tight, why did he not start saving this in Jan when he knew he would have to pay it?

Thanks for your reply getmore4less. I was worried he was taking the p*** about when he was going to pay me but it seems that, although not perfect, his arrangement is ok.

My redundancy letter says notice pay and not pay in lieu of notice so technically he can make me work although i would be cheesed off he somehow conjured up some work for me now after saying that there is no possibility of full or part time work for me (even at a lower salary rate) after thinking about it for the last 7 months!
