I have not sent a letter to them yet, I wanted to be sure what to write and if I qualify and what to expect.
On the face of what you have written I think you do.

That is the template. On line one please substitute default fees for "unauthorised overdraft fees".
State why you are in hardship. Furthermore add a schedule of charges ie the charges you are reclaiming, and a Common Financial statement. Please keep copies. example below

Keep copies and write to your bank. Which bank is it and I will see if I can get an address for you.

    Lloyds TSB.
I have a letter written up but I don't know if it is written correctly.
Is it ok to paste it on here omitting the account number and home address etc?

    RE: Financial Hardship

I am writing to inform you that I am currently in financial hardship. I have registered the details of my complaint for the charges made against my account, however, I am unable to wait for the Bank Charges court case to end as my financial circumstances are increasingly difficult and this in turn is causing me undue desperation ,anxiety and stress .
My account is currently £660 overdrawn (result of charges). I have tried to make payments on my account to reduce this debt however due to the increasing penalty charges you keep on adding, and not being able to support myself and my daughter on my source of income I can no longer afford to make any payments whatsoever.
As I have mentioned previously on several occasions to you my only source of income are my state benefits.
I am a single mother and finding it extremely difficult to keep to the terms of your contract stating I am to make regular payments on my account in order to avoid further charges.
Therefore I am requesting a full refund of all charges made on my account due to my financial hardship.
Please refund all charges on my account within 14 days of the above date, if I do not have a response from you within this time I will seek to take this matter further.

You need to focus their minds on your priority debts. For example, how did the charges start? There was a loss of income going into the account, did you lose your job?
Mention this and that the reduction in income lead to the charges and the effect the charges had, tell them you have priority debts of x amount to rent x amount to water, gas, electricty.
Make the letter about your circumstances and how you have got to the point you have got to today. Does that make sense?

Yes it does make sense. Thanks. I will go and revise the letter. Can I post my final draft when I am done?
