Ebay won't let me revise my items ,'til I take a tutorial on thier interlectual.....

I recently listed a pocket pc and Tom Tom gps on ebay with a disc of various stuff including tom tom software, maps games etc.Ebay pulled the listing saying it had been notifyed by Tom Tom that it was violating thier interlectual property.
So I listed it again not mentioning Tom Tom in the title.(thinking they proberbly wouldn't notice-how to they find them?they can't possibly read through all the listings?)The same happened again.O.K fair enough, but I'm wondering how to list it again, should I just put pda and GPS(is it o.k to mention that this is a Tom Tom one?or is this not aloud ?) and extras-and ask them to enquire what the extras are-do Tom Tom have access to questions between sellers and potential bidders?
Also both times I was notifyed by ebay with an "alert" does this matter? are they counted like strikes?
I went to revise a pair of trousers I also have listed,as I noticed a spelling error in the title, but ebay wont let me, it comes up with this message

"Due to a recent violation on this account, we are requesting that you complete a tutorial pertaining to eBay’s Intellectual Property policy(s). The selling privileges on this account have been temporarily restricted until the completion of this brief tutorial. At that time, you will be able to resume your eBay activities. You may begin the tutorial by clicking on the link below.

http://pages.ebay.co.uk/help/tutorial/verotutorial/intro.html

If you have other eBay accounts, this restriction applies also to those accounts. During the term of this restriction, you may not register any new accounts.

Thank you for your participation."

It also says it will take 10-15 mins.
Well I dont think it is fair ! O.k I was a bit naughty with one listing so fair enough they pull it but I don't think they should jepordize my other sales, I don't mind looking at the tutorial, but not right now when I'm tired and not concerntrating properly,I'l of forgotten it by tommorrow.By which time if I read it tommorrow instead it will be too late to revise my miss spelling.( I know I could of done the tutorial instead of typing this message,by now as my typing is so poor and then I wouldn't of bored you with this post, and maybe the questions I'm asking you would proberly of been answered in the utorial ,but it's the principal of the thing ,it just annoyed me!)
Thanks for bothering to read this ramble!any advice on how/if to list the pda welcome.

If you are advised not to list something yet continue to list it you are asking for trouble.

Ebay don't police themselves, the users do, so it really doesn't matter what you do to try and fool the computer, it is your competitors who will be reporting you, violations are not picked up by machine.

If you get too many warnings then yes you will have problems. Firstly any fees charged on the pulled auctions will remain payable in full, then if that fails your account will be suspended.

I'd always understood that warning are like strikes and stay noted on your account for ever. I had one about 5 years ago for selling a video that they considered adult (Dirty Dancing rated 15!) so am very careful on the id to make sure i don't breach any more rules at all.

Furthermore, many companies have people who trawl eBay as a part of their job to find auctions that violate their copyright and so on.

  • Yes, this is the case. Ebay have Vero's - verified rights owners, and they have the power to get ebay items removed. They do generally go through auctions looking for items. Ebay is not interested in entering into corresponance about removed items. I know of a very major electronics company that is now starting to do this. All they have to do is let ebay know the item number and the item is removed. But they had to go through several hoops with ebay to get this vero status. If you just take the tutorial you will be able to continue list again.

I've never seen Dirty Dancing, but I may just have to watch it, now! ;)

I htink it can be guessed from the Xboxes that all got removed and the PSPs and DS's before that (yes i know that is more than 1 company but I think it shows a pattern), if one company is to be singled out then it would have to be the company that makes Xbox 360, the list of people on here pre Christmas who had listings removed was awesome.
