How to appeal an Unpaid Item Strike when it wasnt my fault?

I stupidly bought 7 items from a seller on 6th March. I tried to checkout but there was no option for paypal, only cq or postal order. Seller didnt have address listed so I emailed him. He doesnt get back to me till 10th. I then send cq and dont hear from him. I then get unpaid item reminder which I respond to with cq number and date. Seller fails to communicate after several emails. He then just gives me a one sentence message saying cq stub does not proove I have sent payment! I tell him I can re-send payment but he wont acknowledge my message. My guess is he didnt want to sell the items to me as I won them dirt cheap! Anyway long story short, I have now 7 unpaid item strikes. He has 95% pos feedback as others have negged him (12 in one mth). I cant even leave him feedback as case closed unless i dispute. Thing is Ive got to trawl though my hotmail looking for messages to copy to email and I dont understand how to copy and paste the weird heading thing - how to do that?

I dont understand why ebay cant just read the dispute communication threads as hear I clearly tell him i'll pay but he refuses to communicate!

So frustrating!!

Can anyone help?

    Sorry - can't help with appealing against the decision, but I wasn't sure how to paste the headers etc. a little while back and was sent the following guidance:

    Hotmail: Select Options > Mail Display Settings > Under message headers
    select full headers > Click ok.

    Hope you get it sorted out!

    Baby - I'm sure that you've thought of this, but just in case..........

    If you sent the messages to him by the Ebay system, then ticked the 'Send a copy to my email' box, the messages will all be in 'Sent' in the 'My messages' section of 'My Ebay'.

    For future reference - I always send cheques Recorded Delivery, but mostly try to buy through PayPal, to stop the problems. PayPal doea have SOME uses. ;)

    Quick question has your cheque been cashed?

    If it has put in a counter claim for non performing seller immediately.

    If it has not been cashed then it could well have been lost in the post in which case you have no right of appeal as you were a non paying bidder. The good news is though that the 7 strikes only count once as they were all from the same person.

    Also why did you not formally respond to the dispute process? You would have had 8 days to do so and if you had responded through the system you would have the right to leave feedback for him. Not responding to the process is almost certainly going to mean that ebay will take no notice of you, the process is there for the sole reason of both users putting their point across.

    No the cheque hasnt been cashed and I stated to the seller that it's probably gotten lost in the post, can i resend payment, but the seller didnt respond.

    I did formally respond to dispute process but as it was 7 items I only did it through some of them. I responded to all but one I think stating the chq number. The guy doesnt take paypal but does take credit card payments so I even asked how I could do that.

    I have the dispute messages saved....

    I had a similar thing happen a few years ago. A carpet cleaning firm were listing on e-bay. I won my carpets cleaning for a really low price. The deal was that I would pay cash when they came to clean the carpets. I phoned them lots of times and they were always too busy/on holiday etc. Eventually they agreed to come, but the day before my mother died suddenly and unexpectedly. I cancelled them and told them I'd phone them again after the funeral, which I did, several times. But when I eventually got home and accessed my computer I found that they'd filed a NPB against me on the day that I'd phone them to say my Mum had died. They never said anything to me about filing a NPB and by the time I got back on line it was too late to respond to the dispute. I got a strike against me, and e-bay weren't interested. A few weeks later I discovered they were no longer registered with ebay.

    During the various telephone calls they admitted that they were using e-bay for free advertising and didn't really expect anyone to actually bid !!

    There wasn't much I could do. The thing was, I WAS an NPB as the agreement was that I'd pay cash. Similarly if I'd sent a cheque and they'd refused to bank it, I'd still have been a NPB.

    You can't win in this situation, and I think you just have to chalk it down to experience
