Tenancy deposit.

I hope this is the right place to post this.

The tenant's deposit is held by the agent and the agent is a member of
The Dispute Service.

On the agreement it states that 'any interest earned will belong to the agent'.

My question: Is this legally allowed or should the tenant get the interest?

The reason on some sites for this is that the agent has to pay a membership charge to the dispute service- but the amount they hold in deposits is far greater than the membership fee.

    We had this in our contract, but as we had to pay extra security deposit we made sure they added into the contact any interest other that period would be returned with deposit to us. Worth a try!
