How do I get out of an Everest Contract?

I would be greatful of any advice on behalf of my elderly parents. They have been pressured into the sale of a 'porch' by Everest for a whopping £20k! Unbeknown to me they signed an agreement in March and then went through planning after paying a £4000 deposit. They have now had the slab and block work completed but fortunaltley I saw the contract in time to halt the work whilst I investigate!

I have asked them for a breakdown of the cost to shed any light, but I can imagine that there is around £10k of profit in there somewhere!

I am naturally concerned about the legal implication of this signed contract though, but for £10k it may be worth taking it to Court anyway?

    Good luck, but I fear your attempts may be in vain. The cancellation period has well expired. Under what terms are you planning to take them to court to get out of the contract?

    If your parents aren't capable of making decisions you should take control of their finances.

    Perhaps your parents want the porch and thought £20k was a fair amount?
  • Yes I read the other theads on Everest. But I'm happy for them to keep the deposit because they have already completed the foundation so that's fair enough.

    I'm now looking to review the cost moving forward.

    Why do you want to cancel the contract? Do your parents want a porch?

    I think you will find it very difficult to get out of it. If it was signed in March, the cancellation period has long since expired. Unless Everest are failing to deliver the end product, I doubt you will have any grounds to get out of it since your parents have already applied for planning permission and allowed work to start.

    If you prevent them from continuing work, they will be quite entitled to pursue your parents for the full amount whether or not work is completed.

    How old are your parents? Have you spoken to them about having signed this contract? Are they aware they're paying £20,000 for a porch? (SERIOUSLY?? Is it made of solid gold??).

    Perhaps phone Consumer Direct for advice, as you might be able to get some help showing your parents were bullied into making this decision, or weren't aware what they were signing up for. It happens frequently, companies not giving the full details of what the costs are until after the contract is signed... Do some research, and find someone with some experience in this area to help you.

    Infact, did they even approach Everest, or did Everest approach them?

    £20K for a porch? I think that's why cancelling the contract is a priority.
