caravan park road conditions

Hi, does anyone know if caravan parks are required to keep the roads within its site in a safe condition? i recently damaged an alloy in a huge hole in the road which is beyond repair but my letter to compalin had no success - they basically said there is nothing they will do about it. I want to know where i stand. Thanks, C.

    Are you a casual visitor or a tenant?Of course they are responsible.Don't ask,tell them.Name the park.
  • We were visitors, we go twice a year to Berwick however they say nobody else has complained so it must not be a problem. I want to write a letter to them stating that the road conditions were unacceptable and that they were at fault but i want to state something like "according to....." any ideas?? thanx very much :) c.

    i dont think you will get anywhere unless it is a chain of holiday parks, if its just your usual 1 owner park i very much doubt they will pay for the damaged alloy, as the site is private property and you are a guest (albeit a paying guest) its not like it has anything to do with the highways agency, you would have to go through the terms and conditions you should have been given at the time of booking
    i wish you luck though, not nice having to fork out for a new alloy, you never know they may pay just to keep you as a future visitor
    Everyones opinion is the most important.....no wonder nothing is ever agreed on.

    Of course by paying, then they are granting you certain rights. One of those rights is a 'duty of care', not only to you and your equipment, vehicles but the others in the vicinity. The duty of care extends to yourself too, so no speeding around on your car. You could suggest that by the car having to disappear into a hole, it caused the wheel to spin slightly as you accelerated out of it, the result the loose gravel they left in the hole sprayed up and damaged the car\caravan. You might also add that it could have been worse if a passer by had been hit by that loose stone as they would be suing for more zeros.

    It could have been worse. At least source code's not combustible, or you can bet somebody at McAfee would have lit it.
  • Well it was at night time and the hole was on the edge of a road leaving a mini roundabout that was not visible to me as the raised kerb on the road i was pulling out of blocked the view of the hole hiding behind it - thats why i didnt see it Takoda!! It was Haven holidays and i have wrote to head office already but with no joy. My alloy is non-repairable :( the road that it happened on was also very narrow (not enough room for two cars meaning one had to pull up on the grass to get passed) so i doubt im the first person to complain about it. I took pictures as proof too just in case. Thanks :) C.

    I'm glad you took pictures.

    They do have a duty, from a health and safety perspective, of maintaining their property. If a car could get damaged in a pot hole, so could someone walking down the road.

    Of course, companies usually have disclaimers on car parks and private roads, but that never excuses negligence.

    If you can prove that the hole was dangerous and should be seen to you'll have a case.
