Purchase on Credit - Company gone bust!

My wife and I made a purchase on a 0% credit card (RBS). We bought dining room furniture which consited of a table & 6 chairs, side board and display cabinet from an independant furniture store in our local area.

We made a deposit on ordering the furniture (£200) and were told to pay the rest on delivery over the phone. The furniture turned up, but the wrong table was delivered. We ordered a large extending table, but they bought a small table apparently due to a mix up at their warehouse. They wanted full payment still as they said they would leave us with the small table so we didn't have to go without one, despite saying that the correct table should be with us the following week (which I knew wouldn't be the case as we waited 6 weeks for the initial order). So I decided to hold back approx £200 which I said I would pay them on delivery of the correct table. The total order was around £1800. The weeks went by, we heard nothing, my wife and I chased them up on a number of occasions, and were assured the correct table should be coming in to the store the following week. The last I heard from them was on the 11th of June, I thought i'd give them a bit of time, and was fed up of chasing them up to be honest. On Friday I tried to call them, only to find out they had gone bankrupt! So, now we are left with a table that we didn't really want, and isn't big enough really for what we need. I'm not even sure of the value of the table as we never really looked at the small table price when ordering the furniture. As we paid on credit card, I am wandering are we insured, where do we stand? Is there anything we can do, or are we just stuck with a table we don't want and that's the end of it? Any advise would be appreciated! Thanks!

  • Thanks for your reply - however, what exactly am I entitled to? Am I covered to recoup the cost of all the goods that I bought. I wasn't given a single price for each item, I was given a whole price for the table & chairs, sideboard & display unit. They all match obviously from the same range. The company I believe used a supplier in the Far East. I obviously want furniture that matches so wouldn't want to be in a position where we get to keep the display unit & side board and have to go and find a table that matches!!! I'm really worried about this, it's not as if we have paid pennies for the goods, we've spent a fortune getting the dining room how we want it, and now it's really spoilt things!!

    My idea solution would be to get all of our money back, return the furniture to i'm assuming the credit card company and then go and buy new furniture from a new supplier - is this likely to happen??

    I'd say you should be able to claim the whole set as you bought it as a set! I bought a lovely hand made set in Harveys and the table was scratched - it was the last one they had so I had to send everything back (not just the table but the chairs, mirrors and sideboard and nest) because the shade of Kashmir didn't go with anything else out there.

    In saying that Harveys just done the swap, no need to do s.75 but i'd say you should be ok - just remember to tell the CC company that you bought as a set and got one price as a set buy.

  • My wife called the Credit card company on Friday morning as soon as we found out the retailer had gone bust. She gave them all the details and they said they would get back to us in about 2 weeks! Is that normal???

    I would say yes - they need to investigate your claim especially as it potentially worth £1800.
    Would you be prepared to negotiate? say keeping the smaller table but getting a % of the purchase price back?
