I though the way it worked was, you get med discharge and if it is "service attruitbable" you get you pension from the RN as soon as you get med discharged.

Then if you dependent on your injury you get a lump sum if is under 19% or a monthly war pension if its over 20%.

but then again it might be down to time served etc! the Service Personnel Veterens Agency are really good theyll come to your house and help with all the forms too.

Sorry to ask if you are sucking eggs but are you sure its not the rn pension your getting.

I was discharged 2005 rn and first got the rn pension and then the spva showed me how to claim for the rest.

    Hi,

I was in pretty much the same situation myself very recently.

The problem you will face is that the burden of proof etc for the War Pension is less than that required for your Service Pension.

So in order to claim your preserved RN Pension early, you have to demonstrate Permanent Incapacity (which you do not have to for your War Pension).

The SPVA will usually argue your condition may not be permanent thus refuse to pay your deferred Pension. You have to put up the counter arguement against this.

My advice would be to contact the Royal British Legion and get them to take up the case on your behalf.. They are very well versed at figting this one (as I have found out very recently!)

    Regards

    Pete
  • Thanks for your reply Pete i applied before and was refused and there was no appeal.

Being on incapcity for 5 years you wold think that was enough evidence.

I now have further medical condition since i applied last time.

    Thanks again
