I've just been looking at the application form and I think what you've been told is correct. That's why they've requested the birth certificates of your children etc... - this is evidence that you fall into one of the eligible categories. I think the only difference between ticking the box and not, is that if you ticked the box you'd have sent the evidence with the rest of your paperwork and it'd be been assessed earlier.

lol now i am confused. I rang student finance who said that if i qualify for the special support grant then i will recieve this even though i did not ask for it? is this correct or are they telling me wrong info?

Nope, sorry, you have to ask for it and prove you are entitled. You qualify for it as your partner is also a full-time student. Send them a letter saying "I believe I am entitled to the special support grant because both myself and my partner are/will be full-time students during the academic year 2009/10 and we have responsibility for our (number of kids) child(ren)." Make sure you include your name and customer reference number.

You have already sent the birth certs and you will have to send some kind of proof that your partner is a full-time student (ask his college).

It is worth noting that the funding your partner is entitled to depends on the level of course he is studying (and his previous quals) not the institution he studies at. For example, you can do HE courses as colleges (like mine). He should see the welfare advisor etc in student services for more info about what is available to him.
