This is getting beyond a joke now, I had sent in a hardship claim form around 3 weeks ago. Prior to this i had used one of the template letters asking that all charges be halted and that any debt collection be stayed until this matter has been addressed. I was claiming back unfair bank charges which have just escalated. It was originally around £560.00 I was attempting to claim back. I had also cancelled other direct debits to prevent any further charges being made and have been struggling ever since to keep on top of things and making sure those companies the direct debits were with are paid. I have also struggled to pay my Halifax loan. The bank has since just sent me threatening letters ordering me to pay up a further £400.00 in their charges which they continue to add. I have told them to stop ringing me as they are even attempting now to charge me for telephone calls.They have now even resorted to attempting to ring me on my mobile on a Sunday and even when i have just done a full night shift they have rang me while in bed. They are constantly hounding me to pay them their money back. But what about the charges they have unfairly taken from me.
Today they contacted again telling me that if i did not pay up more charges will be added and they will also told me this will affect my credit rating. I have told them in so many words to go and get stuffed. Also stating that this is the final straw now and i am going to take this to the small claims court. Hell so what if they hod this off.
Should i pay their charges and just hang around and wait for them to refund me? Or do i stand my ground and fight them. My concern is this getting out of control and me being found up to my eyeballs in debt. My relationship finnished because of all this and i am now of no fixed abode and relying on family to help me out. The bank the scourge Halifax are taking no notice. If i don't get any help shortly i will file for bankrupcy that is my only way out of this mess. Yes i went overdrawn and i sorted this out and got myself on track but the bank the following week applied another load of charges and they have so ever since charging me for charges. What do i do now??
Take them to court. I have just sent the bank my final letter stating that i want my charges back or i will settle this matter in court with immediate affect.

Do you have any priority debt arrears(mortgage/rent, council tax, utilities)?
Are any of the arrears on a payment plan?
I would also remind halifax that the account is in dispute since you are willing to deal with the account once the OFT test case issues have been resolved.0 -

Ok, you don't have a hardship claim with them without priority debt arrears. The £500 in the waiver is merely an "indication of financial hardship".No debts at the moment only because i have struggled to keep my head above all this.
