Cash converters refusing refund

Afternoon all ,

I've just had my mom on the phone , very mad after dealing with staff at a local cash converters!

A couple of days ago she and her partner bought a set of brand new speakers for £90. Her partner is a singer and used them at a gig last night and they were awful , constant distortion etc. they are useless to him.

Today they returned to the store with the speakers , boxed and also their reciept. They explained the problem and were told if they were claiming they were faulty then they would have to wait until monday for them to be tested. My mom's partner explained they may well not be faulty but they are no good for what he was assured they were suitable for (if that makes sense?! lol!) by the staff member who sold them to him.

They were then offered a credit note or to sell them back to them at a reduced price!

It resulted in basically my mom and her partner rowing with the assistant manager and manager. Not the best idea really as the manager hid out the back and refused to talk to them! lol!

My mom rang me on her mobile to explain what was happening , the assistant manager wouldn't talk to me on the phone either. I advised my mom to get the names of who she's dealt with today along with head office details. She was told there was no headoffice details they could give out as they are a franchise?! (i've since found the head office address on their website) There were no business particulars on display for them to see and get the details either.

Now i'm going to e-mail HO to complain about the awful service but do they have a right to claim a refund under SOGA? as they weren't fit for the purpose they were sold for?

    If the speakers are faulty or poorly designed then yes you are entitled to a refund. They have been used once, found to be unsatisfactory and returned to the shop quickly. I can well imagine the manager cowering in the back office - Cash Converters really is a low-rent chicken-!!!! operation.

    However there might be some uncertainty as to whether the speakers are actually faulty. Specifically, with speakers it is very easy to overdrive them such that they will be working correctly but will nevertheless distort. I would also venture to suggest that any speaker(s) costing £90 simply isn't going to be any good to start with.

    They were bought brand new , they seemed to have a job lot of them I believe. They retail in other shops at £280 apparently , and the lad that sold them to them bought up a load of stuff on the internet showing how good they were and they'd won awards etc. So they believed they were of good quality.
  • It isnt a consumer sale as your mothers OH purchased them for a business purpose.

    As for the speakers. They dont sound faulty but more you tried to buy cheap speakers were you needed good ones

    Nope. Didn't you read the Makro thread about SOGA and consumer and b2b transactions? SOGA definitely applies here.

    In any case you don't actually know that the singer is professional because it definitely does not say that in the OP's post. Not that it would make any difference if he were.

    Do you know the make/model? (It's not important, I'm just curious.)

    I don't know the make/model at the minute , i'm waiting for my mom to pop over and give me the details.

    I guess he is classed as professional , he sings in a couple of local hotels on a weekend.

    To me the words good quality and cash converters just don't go together.

    I wouldn't know to be honest , i've not been in one for at least 10 years. I didn't even realise they sold new stuff!

    It makes a difference. If the speakers have been bought for a business purpose, then parts of the Sale of Goods Act, especially dealing with remedies, will not apply.
