True, but the main onus is on him - he's the driver. It's he who would lose his license, or at least 6 points and a fine.
The question here is if they asked if he had insurance. If he answered yes, they may say he was driving under his insurance - which would only be third party.
What they have sneakily tired to do and have done is show it wasn't just a test drive, and that he took the car for a trial period under HIS insurance.
Totally depends on their policies which we don't have to hand0 -
This is insane.
The dealership have a Motor Trade policy, they would need to by law have insurance for the vehicles registered to them. There isn't a chance that your dad wasn't insured, especially when dealing with an Audi dealership, surely? If he wasn't covered under their insurance then they don't have the correct insurance themselves.
I can remember being told only once during a test drive that if I damaged the car that I would have to pay the excess on it. No one else has ever mentioned it. The reason they take your driving license is to cover you under their insurance.
I would follow this up with the legal cover on my own insurance policy and contact the directors of the dealership asking for clarity on their insurance situation.
Why on earth would they tell someone to say it happened elsewhere? I can't think of a test drive I've had where the salesperson hasn't first manouvered the vehicle into a safe place for me first. They'd never usually ask you to reverse out of a space - maybe they felt they'd be held responsible?Everything that is supposed to be in heaven is already here on earth.

Did your dad hit a bollard on the Audi dealer's premises eg their forecourt or was it on the public highway eg the road0

They may of told him to take it off the grounds, as it was done on private land, if it was done on the garage forecourt, and some insurances wont pay out if done on private land, also where there any trade plates in the car when he took it on the road, because if the car wasnt taxed they have made him break the law, as a lot of cars at garages dont have tax on them0

This is incorrect, a motor policy does not exclude claims on any private land except airside.0 -

And it will no doubt have a significant excess on each claim meaning small bumps and scratches arent claimed for.
As for harassment. It isnt really. the OP's father damaged the car and whether its covered by insurance or not iff his neglience caused it he can be pursued for that cost.
Would you think it acceptable for your neighbour to crash into your car and refuse to cover the costs because you were insured?0 -
