Claim for personal injuries 2.5 years after being in a crash, when they could have claimed through the other persons insurance at the time (like they did when they claimed for their car)
Plus, when someone claims against you, what do the forms look like? (Or what forms should you receive)
Received a load of gobbledigook for OH for a crash which happened in almost 3 years ago, loads of bloody lies on it ~ not happy at all. :mad:
Think it's a no win no fee solicitor they have gone through, but can't understand why now?!

Because they have been stopped in the local shopping precinct by one of these no win no fee companies, who have asked if they have had an accident in the last 3 years - and then smelled a good commission when the person said yes!
I think 3 years is the limit you have to make a claim in circumstances like these - but then I would argue, if the 'injuries' were that bad in the first place, why did they not act then?:j Almost 2 stones gone! :j

3 years is the limit for injury claims. Providing they are within that timescale there is no argument you can put forward to prevent them sueing you.

Thanks Sagaris, that's what I thought, why now and not then?!
Matty, the lies vary, from the weather at the time, to where it occured (traffic lights V roundabout with no lights in the near distance), the time it happened (form says one time/docs report states a completely different time) and also on docs report it states that they had never been in a RTA before......but OH was told at the time of the crash by the lads dad that he had had another one 3 weeks before! There are more lies, but can't think off the top of my head, that was just what I picked up skim reading it.
How come he can try to claim from OH now though? Can he not go back through his insurer??
5K he's claiming for, then there are the solicitors costs on top of that ~ plus court fees?
We can't afford that, we've just had a baby 7 weeks ago

Wouldn't it be down to the company you were insured with at the time to deal with?
Have you still got any of the paperwork you sent off to that company at the time you could refer back to, although, again, the insurance company should have all that.
Were the police involved with the accident - if so, I wonder if their records would confirm your version of events?
Not a nice thing to have land on you though.
PS My mum had a minor prang in her car just before Christmas, and it was all sorted - or so she thought! About a month ago, she had a horrible letter form a solicitor's, claiming extortionate amounts of money for the other party (and no receipts provided!) for a hire car (at £80 a day!), loss of earnings (although she told my mum at the scene of the accident that she didn't work), expenses for postage and phone calls (over £100 - you get the picture!). Mum had changed her insurer in the meantime but rang the original one, in a panic, thinking she would be liable for the £1200 that the other party were now claiming for various things. The insurance company said she was not to worry about it and put it in an envelope to them and they would deal with it - which they have.
I think a lot of these companies try scare tactics to panic people into paying up - certainly mu Mum was very upset with it until I told her it wasn't for her to deal with.

I'd just pass it to the company you were insured with at the time to deal with....Bern :j0

Yes he's still got paperwork. He rang them earlier, just before they closed and they said that the little git (he was 18 in a souped up car, crash 3 weeks before too? wanted a new car? who knows?!) was paid out money at the time, but OH thinks that would have only covered his car.
He's got to ring the claims department first thing Monday morning and see what exactly happened with that claim. (They closed at 5 today, booo)
Do you think OH will be able to get something from the ins company saying exactly what was claimed for and details of the claim (ie, when and where it happened etc)?? If so, this could help a great deal.

As sagaris says - the co your OH is (or was at the time) insured with should deal with any personal injury claim against him as a driver. The claim has to be against the individual but the insurers will deal with it and cover any damages and costs I would have thought.
Does sound like one of those scummy "where there's blame, there's a claim - even if there isn't any blame, type outfits.
EDIT: Posts crossed I think but on the face of it - you shouldn't need to worry about the cost of the claim.0 -
They probably wouldn't give you any details (data protection and all that) but would just sort it out anyway.
Chancers like this really make my blood boil - someone has obvioulsy seen a chance to make a fast buck - hopefully your insurance will see them for what they are!
In any case I don't think it will impact on you financially - isn't that what we pay our insurance for!:j Almost 2 stones gone! :j

They were both insured with the same company at the time. Don't know whether the lad still is, but OH has changed since then.
What's this form we've received then? It's been stamped by our local co court? (Sorry, I haven't a clue about things like this!) And also there are 'defendant' forms for OH to fill in?!

Did you tell the insurance company about these forms? The ones my mum got were 'stamped' too, but you couldn't make out what it was supposed to be - and did threaten that is a satisfactory resolution was not reached they might possibly, perhaps, be taking her to court. Scumbags.
How can they be taking him to court though? Is there any reference number on the forms so we can find out what they are?:j Almost 2 stones gone! :j
