quick question re data protection act

hi all just a quick question reading regarding purchasing a tv

Under the Wireless Telegraphy Act 1967, all retailers selling or renting out television receiving equipment are required to forward customer information to the TV Licensing Authority within 28 days of purchase.

We are legally obliged to obtain this information when selling a television.



i know from previous experience that asda used to have a tv licensing book and make you fill that in but different stores act differently

what i would like to know is dose the store have to ask you for these details or are they just allowed to copy them from different means ie

delivery details
cc (name)
gift card with accompanying letter with your details on

also this is the main one ive googled but can not find an answer

    Yes, resellers will use the delivery address when selling notifiable equipment remotely. I think there have been occasions where people have had items destined for home delivered to work (for reasons of convenience) and the workplace has been subsequently investigated for not having a TV licence.

    Yes the DPA does apply when you buy a TV. However, DPA does not mean that your details can not be passed on - it simply means that there must be a legitimate reason for passing them on and they can only be passed on to the relevant authority for that reason.
    Warning ..... I'm a peri-menopausal axe-wielding maniac ;)

    In any event, the form that you fill in does not necessarily contain the name and address of the new owner of the TV, does it? The shop has an obligation to forward customer information . However, there is no similar obligation on the customer to provide the details of the owner. As far as I know.
