  • Hi - At what stage should one put in a claim for a second soliciters fees and the land registry fee? I have already paid WS but the property is not registered. I have paid another soliciter to try to sort out the registration (this will be done with great difficulty as the sellers file and the sellors have long gone) So far I have paid £400. but I suspect that it will cost a lot more. So should I put in a claim now or wait untill it is sorted. If it ever gets sorted and where do I claim from. Thank you

    Get your second solicitors to do it - they'll know far more about it than you and if they !!!! it up then you've got a claim against them!
  • Hi I dont know about you but the idea of my new soliciters !!!!!!! it up would be the end of me. I do feel for everyone cought up in this. This forum is brilliant because people not cought up in this simply dont appreciate the stress and the way it takes the pleasure away from it all. I guess I just dont trust anyone also I am afraid to run up big bills that may not be covered in the long run.
  • Thanks for the advice. I think they are. It's First Direct, so any experiences anyone else has had with them would be welcomed. I rang on the day of the original completion and they were not entirely helpful or even bothered that their money may have gone "walkabout" and they advised that I contact the LCS. Subsequently I've advised them who my new solicitors are, and they have approved them and sent over copies of the offer and various other bits and bobs to my new solicitor. I'm pretty much leaving it in the hands of my new solicitors now though who, in fairness, seem to be doing a reasonable job but I will double check with them.

    You should be alright then. Those of us with Abbey had offers withdrawn however after much hell raising they did eventually re issue my offer at the same rate I originally had it at. But if papers have already been sent then it sounds as if they are happy to continue with matters. Best of luck.

    Try not to worry. Most solicitors are very competent. It's the useless ones who have to resort to advertising cut price work on the internet who are the cowboys. Just ask your new solicitors to put your claim in for you for a fixed fee and say that you'll deal with the rest of it yourself.

    Try not to worry. Most solicitors are very competent. It's the useless ones who have to resort to advertising cut price work on the internet who are the cowboys. Just ask your new solicitors to put your claim in for you for a fixed fee and say that you'll deal with the rest of it yourself.

    I do feel more comfortable with my new solicitor. Are you recommending he puts in the claim to the SRA then? If so then what else is there left to do?

    Not a lot. They agreed to release sale monies but want MY money returned to them after sale complete and sol not happy to do that. Still trying to sort out insurance issue on sale house too. Will keep you updated. Any news in yours?

    Thanks, just to finish this off then:
    The new solicitor can put the claim form into the SRA to cover the money WH did not pay for SDLT, any penalties imposed by the IR for late payment, registration, his own fees for completing the work and for submitting the claim form?
    Is he then also the best person to submit a claim to the LCS for stress and inconvenience, should I decide to go that route?

    If it were not for the forum I think I would now be on much stronger medication than Super Strength Cider!
  • Hi if I go the route of letting the solicitor put in the claim for compensation what is it that I am actually asking them to do. I know it sounds daft but it seems that there may be 2 claims 1 for the soliciters fees to complete the work that WS did not complete (even though they had full payment) and the other for stress and the resulting problems of that. And should I ask them to do that now or when everything is sorted. Thank you
