  • I wonder if files really are missing or perhaps they were never opened in the first place? Would it be true to say that all those who paid money upfront to WH have missing files? Perhaps WH just took the deposits and never opened a client file.


    More than likely and anyone in this position should mention this to DWF. They should at least be able to reconcile any payment made with an entry in WH's client account. I suspect that their client account will never fully reconcile as there Accounts department was a shambles. Indeed I would not be at all surprised if they end up with money in their client account which they are unable to post to any partivcular client. I wonder what the SRA will do about that.

    Well my sellers files are conveniently missing = unfortunatly we both used WH without realising. Then when I questioned WH about it they said it was ok as it was different offices. It struck me that as no paper work was sent across at completion (none to be found) that along with the missing file was proof of the extra £140 that was paid for the indemnity insurence ( I paid the sellers half toward it) I have chased several firms to try and find the policy without success. (as I have said before sellors have emigrated) I wonder how many other people have not had indemnity insurence paid - or how many files have gone missing that should have contained indemnity insurence policies.

    Went to see my file yesterday at new solicitors, in this respect I seem to be one of the few lucky ones. Everything was there including the indemnity insurance paid for by the seller and the deeds and transfer document. Now need to get all the money back and seems we could be in for a bit of a wait, but let's see what happens.

    Cara at the SRA is also my advisor and has been great so far we are currently in the process of sending her evidence and she is hoping we will be paid our 20k end of feb.

    The only thing that is different to what some people are stying is that she has said we cannot claim for interest from her or our Wolstenholmes fee's back - but we can claim fee's for new soliciter. She said the LCS have to sort out interest fines and the original wolstenholmes fee.

    To those who have not heard it took about 2 weeks for the SRA to write to us. I think they have a priority system in place based on when the recieve the form and size of claim etc. But do hang in there - since Cara has been invloved i have felt a lot better!

    It would be nice if they all sang from the same hymn sheet. The SRA helpline yesterday said IR fines and interest due to them would be on an SRA claim and the LCS careworker said not to make any claim at all until all complete.
    Frustrating even at this stage of the game.

    Who did WH Use to provide the indemnity insurance. its been doing my head in trying to find a copy of the Policy that was taken out on my property. I have rung so many insurers with no luck. If I could find the Insurers I could at least ring and get a copy of the policy.

    My case file has been allocated to Cara at the SRA too and I agree, she is brilliant. With any luck, I should be receiving my money by 12th Feb. Not only does Cara do what she say's she will do, but always keeps you informed so you never have to do any chasing. I wish everyone had the same work ethos - it would make life so much better.
    Thank's to Cara's intervention, our chain is intact and we can go on to complete.

    It was taken out by my sellers who were not, thankfully, using WH.

The house insurance policy (buildings & contents), which is now in my name as Executor, is valid until 30th April 2010. I'm hoping to complete the sale in February. Will I have to pay indemnity insurance or is it covered by the house insurance policy? My new solicitor hasn't mentioned anything about indemnity insurance. As I live abroad, I'm not au fait with the ins and outs of selling a house in the U.K.

    It has nothing to do with the house insurance and as you are selling it shouldn't apply to you.

    The Buyer's solicitor may arrange indemnity insurance for the buyer if for example they don't intend carrying out pre contract searches or there is a defect in your title or some such other thing. If there is a defect in your title then you may be asked to pay for or contribute towards the premium

    Don't know who they used - they may have used more than one. Google "title indemnity insurance" and you'll come up with a list of suppliers. Try them in turn. They should be able to tell you if they have issued any insurances by reference to post code. The most commonly used are Norwich Union (now Aviva) - they fax quotes on the basis of a telephone call
    First Title (recommended by the Law Society)
    Guaranteed Conveyancing Solutions - a lot of solicitors use them as they can self issue a policy.
    There are others.
