Pls Help FOS have agreed with smile bank

Hello,

I have looked at threads and can't see anything like this, i have been trying to get my bank charges back now for a while nearly 2 years and the FOS have been involved since last summer! i have claimed financial hardship. I have received a letter from Smile bank accepting that i am financial difficulty so this has been acknowledged. The FOS appointed an adjudicator she wrote to me yesterday to say that 'the bank says that it has looked at your complaint having reviewed your financial position on the basis of information about your financial circumstances which you have supplied to it. However, having done so it does not accept that it is under any obligation to do anymore at this stage. Having considered the position very carefully, i am inclined to agree with the bank's assesment.!'

Please help i thought the FOS would get results for me not side with the bank when it has acknowledged im in financial difficulty.

I'm not stuck and dont know where to go from here please could someone help me as to where i go from here....

I am at the same stage with Lloyds now too am waiting to hear from them as well....

I must say i haven't incurred any chrages now for 4 years....mended my ways thanks to Martin and his crew....

Many thanks and kind regards

i would tend to agree with FOS and smile - you may be in hardship now but the charges havetn affected said hardship as they were so long ago.

their obligations don't extend to paying out in such circumstances

these might include: help and guidance about dealing with fd and avoiding charges; suspending collections and recovery activity; suspending accrual of further interest and charges; consideration of a refund of charges, in particular where the charges may have added to the FD during, or immediately before, the period of FD. The rationale for why a particular level of refund has been given should be documented and clearly explained to the complainant.
