Mini one gearbox-rights as warranty expired

Hi, this is my first post. I have a BMW Mini One 55 plate Auto., and the warranty has expired -although I still have the option of renewing the Service care package before it's next service..
I had the car when it was 6 months old, March 2006. It's done 55,000 miles.
I have recently had problems with the car not automatically changinging gear at around 55 -60 mpg, if I put my foot down and go around 70mpg it then clears, but again as I come back down in speed it happens again. This is the 3rd time it has gone into Sytners with this problem, last time it happened was Jan 2008 and before that possibly 6months to a year before.
. Previously they have said they have reset it. But guess what, this time they have asked mini about the problem and mini has said it needs a new gearbox. Sytners say that will cost £5000. They are now going back to Mini asking for them to look at contributing. I feel that as this problem was there early on, there must have been something wrong with the gearbox all along. Does anyone know where I stand on this? I desperately need my car for work as I travel from place to place and the repair is nearly what the car is now worth.
02/07/09 Good news, BMW are funding the gearbox and Sytner contributing to fitting- happy ending afterall!
