Hi,
we purchased some bathroom fittings a couple of months ago, including a shower screen. As we were not yet ready to have the bathroom re-done, we placed all the items, still packaged, into our garage for storage. Whilst on holiday last week we had a chap install our new bathroom and he discovered that several of the fittings on the shower screen were broken. This has NOT happened whilst the item was in storage and we are confident our installer did not do it either.
Having just phoned the retailer we have been told we cannot have a refund because for all he knows we or the installer could have caused the damage bla bla bla.:mad: We saw no reason to open the stuff when it was delivered but in hindsight we realise now that perhaps we should have.
Is the retailer operating within the law ? I take it all we can expect now is a replacement or credit note ?
Any advice would be appreciated.

I am not even sure you could get a replacement or credit note, unless the supplier has said that he will provide that. It's hard to make a firmer statement without seeing the nature of the damage to the fittings but at the end of the day it's your word against your installer against the supplier. If you can get free replacements I'd say take them.0 -

If you've has the items for a couple of month, they are very unlikely to do anything at all, unless you can PROVE the items were damaged when they were delivered. But seeing that you've already said you didn't check them, you will be lucky to get anything back from them. They aren't legally obliged to do anything at this point...If it looks like a duck, and quacks like a duck, we have at least to consider the possibility that we have a small aquatic bird of the family anatidae on our hands

unfortunately I think you may have to take this as a lesson to check anything before signing for it even if you do not intend to open it for some time. As a company I can understand that as far as they are concerned they did not hear from you in the required timeframe and you cannot prove they were damaged when you received them. Only my opinion though0
