Lloyds TSB/Solicitors letter!

Good afternoon folks.
Below is the copy of the letter we received from LLoyds TSB Solicitors, never been in this position before, so will be happy to hear of what we should do here, we are clients of the CCCS, paying token payments ourselves to all lloyds tsb creditors, 4 of them, only missed a month, almost 2 now, but last week we received the first default notice, and have until its either the 8th or 9th July to pay, and yet we receive this solicitors letter today below:

Dear Sir/Madam

29 June 2009.

Our Client: Lloyds TSB PLC and/or/Lloyds TSB Scotland PLC.
Personal loan number xxxxxxxxxxx
Personal account Balance: £10,525.38
Arrears: £227.84.

We are instructed by Lloyds TSB who advise us that despite several reminders your account remains out of order.
This letter, therefore, makes formal demand on you to repay the balance quoted above less any rebate, which may be due in respect of settlement within the agreed term of the loan.
Our client will provide full settlement details upon request.

If payment is not received by our Client within 14 days from receipt of this letter, Legal proceedings may be issued against you without further reference. Once proceedings have been issued, you may be liable for legal costs incurred. In order to avoid this action you should make payment into Lloyds TSB branch. Alternatively you can send a cheque made payable to our Client to the above address.
Please write your account number on reverse of the cheque.

You are advised that is is out client intention that the information relating to your failure to pay will be lodged with the following Credit Reference Agencies: Experian Ltd, Eqifax Europe UK Ltd and Callcredit PLC. This information will remain on record for a period of six years.

Our client tells us that you should also be aware that it is common practice within the finance industry for this information to be used when assessing your ability to manage your finances and it may be that this will also affect anyone who you might share a joint account.
Furthermore, we are unstructed that if the debt is settled within thie prescribed period this fact will also be recorded, but will not lead to the original default being removed.

If you are unable to pay the full balance, our Client may be prepared to accept a reduced sum, together with realistic proposals for regular monthly repayments. You must telephone our Client on 0845 600 6294 immediately if you wish to discuss such an arrangement.

REMEMBER, THIS IS A FORM DEMAND PRIOR TO THE COMMENCEMENT OF THE LEGAL PROCEEDINGS AND YOU ARE STRONGLY URGED TO MAKE IMMEDIATE PAYMENT TO AVOID THE ACTION ABOVE.

Right, so what should we do now?
The mortgage arrears comes first and despite this letter, we have sent them a stupid amount of about 15 or more letters in the last 3 weeks, to make them aware of our situation and the mortgage arrears of over now £3K.

    Hi Di,

    Your mortgage arrears do need to take priority over unsecured debt. The letter you have received is just a standard letter. If any of your debts change hands, all you need to do is change who you are paying your £1 to. You may also want to send them a copy of your budget and list of creditors so they are aware of your situation.

    Give me a shout if you need any further help, but try not to worry about this letter.

    Even though I had sent copies of the budget statements with the token payments, also a copy of the letter in regards of the mortgage arrears, do I write to the solicitors as well not not ring them as they requested, so we can then send them the copies of what we have to them by post?

    We pay a £1 to each of the 4 lloyds tsb creditors, as they are all with them, so far they have not been lenient, a default notice within 3 weeks of when the first loan was due, despite them taking the token payments, where all the information of the budget information was enclosed.

    So this solicitors letter where they are demanding for full balance of the loan, is just standard then I take it?
    If this is not repaid, by the date they have stated (14 days as from the 29 June 2009), should I then expect to receive further letters from the solicitors?

    Hi Di,

    The time does vary between different companies. The default letters are standard system generated letters so will have gone out to quite a few people in the same boat as you at the same time, so really nothing to be worried about.

    With regards paying the full balance within 14 days, I’m sure you would if you had the money but you haven’t so continue to pay the pound. When the account is defaulted they do ask for the full amount.

    The key is not to give in, stick to your guns and keep paying the pound. Once your mortgage is sorted then we can take another look at it ;)

    My husband attended an job interview the other week, he should hear something either this week or next week, then obviously the finanical side should improve, fingers crossed.

    Just checked out the solicitors by googling them and have found some interesting information.
    Infact these are actually those of Lloyds TSB DCA staff acting as solicitors.

    Am I able to post the name of them on here or not?

  • Hi di, I am expecting one of those letters re my loan. I hate Lloyds. I am in the middle of doing forms to send to the Financial Ombudsman re PPI and just general complaining regarding how I feel they are handling my debts! Badly!

    Anyway, they have refused new payment proposals for my loan and O/D which is more than they were getting. Very kind of them. I have thought loan ins was coming off the loan.....oh, the will only do this if I sign the form to say I will continue to meet the £25*.** a month payment! I told them on the phone I cant pay this, tough, they can't remove the PPI then!

    I am sick to the back teeth of Lloyds. I fell out with them yestrday big time. I said funny how you ring and hound me but when I ring and hound you for help you aint interested. I said I could understand if I was not willing or making efforts to repay you but I am. I was rude and hung up. Usually am not but the hot weather and their continued incompitence, I saw red!

    I have sent two letters of complaints to them and have received no responses. I am now thinking of writing to the top boss. When I eventually, if ever (thanks to Lloyds) repay my debts, I will never go near them or anyone connected to them. When you don't have debts you don't bother them, they don't bother you, the min you need help, they shut the door in your face.

    Sorry for the moan and i know this does not help you, but you are not alone in your fight with the Evil bank. xx

    So sorry to hear you having to go through this as well, but well done to you with speaking up for yourself.......:T:T;).

    I know what you mean though.

    I sent the email attachments by Internet banking and through the post, to make sure the complaint letters have been received, Internet banking do get back within the day to confirm they have sent to the dept I requested and I have actually received a letter back from the complaints dept to let me know they are looking into it, but this was on the 15th of last month.

    We have since been harrassed with daily letters, we only started our token payments last month and they were on our back within days, with a default notice and now this so called solicitors letter.
    Where I have checked that really they are lloyds workers acting as solicitors as such.

    I just googled the name of the solicitors in and plenty of information came up about them.

    Also in regards of your PPI, I wish you luck as well here.
    They are hard work, but we will stick together on here and get through.

    As its all still quite new to me, I ask things all the time lol, but I'm sure I will get used to it, afterall we cannot pay what we have not got can we?

    Oh and only to say as well, the way its going I will be going to the FOS about this debt matter as well, they have ignored everything so far. x

  • That's a common con by the Highway Robbers, using an in house solictor to send a naughty legal letter demanding money, its been around for years, I still think those monkies reckon people will fall for that old pony trick lol

    They will try every trick in the book to get money back from you, even though you haven't got any to pay. Keep paying the £1, tell them they should be very grateful to receive that, if they continue to take the p$$ out of you tell them that you will put them name in a hat for the monthly draw as to which luck creditor gets paid for the month but of course you can;t guarantee they will be the lucky ones LOL!
