advice on getting marketing fee back from ea

I have posted on here before re this estate agent but with one thing and another I have not got rid of them yet. The main reason is that i have paid over 400 pounds up front for a marketing fee which i cannot afford to shell out again and they only refund on completion. So far, since March I have had no viewings and they say not one bit of interest. I had to rewrite their brochure as it was so full of mistakes and very badly written , chase them for updates(although now they are getting better with the latter) and although the housing market is very slow at the moment - a house exactly the same but on for 30k more around the corner has had a veiwing. I have mystery shopped them 5 times now. They sent brochures to 3 out of the 5 and the other 2 haven't received anything to date but the latest shocker is that, despite giving matching criteria, they didn't even offer my house. Yet all the time they maintain they have had no interest.
My question is what is the best way of trying to get my marketing fee back if at all? Also before I approach them would anyone look at my brochure for advice as i am well aware it may be my pictures that are also letting me down

    A retired senior partner, in own agency, with 40 years experience in property sales & new build. In latter part of career specialising in commercial - mostly business sales.

    What was the marketing fee meant to cover?

    If it was to include the cost of someone to supply and erect the sale board (hired by the EA), and for a printer to print the schedules (someone hired by the EA) then anyone hired from outside the agency will expect to be paid, regardless. If the EA has to pay them for their services, they're unlikely to want to refund all of the marketing fee to you.

    good point googler - I will ask them. Think it was meant for advertising via newspapers of which there has only being 2 locally.

    Do you have anything in writing yet, or kept records of phone calls when you have complained? Did you put the house on the market for what they advised?

    thank you all for your private messages they are really helpful. Yes i did put it on the market for what they suggested. I also asked them if i should put it at fixed price and they said no. I also asked them if I should lower the price and they said not unless it is by about 40%, otherwise don't bother. Since I am not prepared to drop my house at the present time by nearly £160,00 thought it best to heed their advice and stay put with the price.

    How long has the house been with them (EDIT - sorry, since March, I see), and is there a minimum term in their contract?
