CSA - What action or rights do I have?

    In most cases though the committal is a kick up the backside for the NRP who had thought thusfar that they had got away with it. Let's hope he's one of those.

    OP, just read your thread with interest. All I wanted to say was please go speak to your MP and see what they can do to help you. Once they get involved the CSA will have to respond within a set amount of time. They usually have open surgeries where you can turn up with the children and it is evenings and weekends.

    Our last one we had (Cons) was fantastic in helping us, replied to emails and sent letters on our behalf and following up when we was about to be made homeless - the one we have now (Lab) is useless and will not get involved in housing cases but seems quite happy to be photographed locally whenever the opportunity arises for the local paper. But try regardless as yours might be a good one. Have a look on their homepage (they should all have one) and you'll be able to see how you can get their help. An email might be sufficient.

    Thanks for your advice, will look up who my MP is and make contact.

    Well my ex is at court again for the commital to prison next week on the 28th, the judge has instructed him to turn up with a years audited accounts from his accountant. Failure to provide his audited earnings will result in him going straight to prison. So just have to wait and see has he told me he would rather go to prison than pay me.

    Has there been many successful order for sale? He has a property and currently owes me £6000 that is without the other PWCs debt.

    To date None there has been no direct evictions there is about 14 cases where deals have been done. Over the last 12 months Orders for Sales have been part of a case study. Last month the comission awarded 4 contarcts to begin the enforcement of over 19.000 order for sale.

    CMAC - you are joking!?! How come?

    So what is the point of it? Am naively hoping that the NRP pays up to prevent the order of sale.

    No I not joking there is alsorts of problems when you jump from a statutory scheme to the legal sytem which is what happens with this level of enforcement. As I said a lot of lessons have been learnt over the last twelve months.

    Just seems a big joke, my ex is living the life of riley, both he and his wife are driving around in convertibles, having holidays in Fiji, New Zealand and Australia to name a few. Bought the house last year and have done it up. And the wife doesn't work!! While I am struggling to make ends meet, my house in desperate need of a new bathroom due it leaking and my kitchen ceiling is on the verge of coming down because of the leak! My wages go to pay the mortgage, pay the bills, put food on the table, buy clothes and school uniforms and am lucky if I get a night out or new clothes,shoes etc once a year!!

    CSA needs to change and get tougher quicker on these NRP who refuse to pay and use every stalling tactic possible to keep not paying.
  • Sarahx1 - I know exactly what you mean. It isn't right that more can't be done. The CSA need to be given more power to get tougher, and then once they get that power, do the work needed.

    I won't steal your thread here, but will comment on what I've done (I'm due over £9k arrears if CSA could enforce my ex, but he's moved countries).....CMAC suggested I write to him, I did that, used CMACS suggested format and words (thanks CMAC) basically threatening that I'll take things further via court system, and suggested he contact me within a certain time period to come to a financial agreement. Well, he did! Contact me that is, mostly to tell me how hard up he is and he'd think about "how much he can afford", lol He sounds like your ex (holidays, not to mention a house in the south of France) So, I definately know how you feel, I too work like you and struggle just to pay the bills every month.

    I definately think you should get your MP involved (and hope he isn't labour) - I did, and it kick started the CSA. Could you try a letter too? You never know.

    I won't hold my breath with regards to the success of mine, but you never know. It beggars believe how these nrp can live with themselves!

    Thanks for the support Playinghardball, you just get sick of fighting and the time and energy it has cost me. All of which is taken away from my kids.
    My MP is labour so I don't think I will go down that avenue, it comes to something when you have to be smarter than the CSA to make sure they are doing things right and question why they haven't done x, y or z yet!
    If it were not for the fact my ex lives 20 seconds from me and constantly gloats and laughs in my face I think I would have given up. I will persue the Force of Sale avenue next with avengence!!

    Gosh I do hope that you get the money you and your child(ren) deserve and they all should be named and shamed publically...........abit like a crimewatch where the general public can phone in with info to help locate them and with financial info. Well we can dream can't we.
